AN ORDINANCE AMENDING TITLE 6, CHAPTER 2, OF THE ORLAND PARK VILLAGE CODE IN REGARD TO DUMPING OR PLACING GARBAGE OR RUBBISH ON PROPERTY WITHOUT THE OWNER’S CONSENT
BODY
WHEREAS, the Village President and Board of Trustees of the Village of Orland Park (the “Village”) have the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and officers and to protect the public health, safety and welfare of its citizens; and
WHEREAS, pursuant to 65 ILCS 5/11-60-2 (2010), the Village President and Board of Trustees may define, prevent and abate nuisances; and
WHEREAS, it has been made known to the Village President and Board of Trustees that there have been instances of persons dumping or placing garbage, rubbish, waste and recyclable material on property not owned by such persons and without the permission of the property owner thereby causing garbage containers and dumpsters to over flow, or the garbage or rubbish to be uncontained, resulting in conditions injurious to the public health and safety of Village residents and citizens.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:
SECTION 1
The above recitals are incorporated herein by reference as though fully set forth herein.
SECTION 2
Title 6, Chapter 2, Section 6-2-2-4, paragraph 2 is amended so as to provide in its entirety as follows:
6-2-2-4: GARBAGE AND RUBBISH:
2. Garbage or Refuse on Premises:
(1) To cause or permit to remain on any premises garbage, offal, refuse, ashes, miscellaneous waste or any animal or vegetable matter which is likely to become offensive or injurious to health or to be blown about by the wind, for a longer period of time than twenty four (24) hours at any one time, except in metal or concrete containers with tight fitting covers thereon from which regular garbage collection is made at least once a week, provided, however, that grass clippings and leaves only may be contained in plastic bags.
(2) To dump or place, or to cause or permit to be dumped or placed, any residential or commercial garbage, rubbish, waste or recyclable materials on any premises or property in the Village without the consent of the owner of such premises or property.
SECTION 3
If any section, paragraph, clause or provision of this Ordnance shall be held invalid, the invalidity thereof shall not affect any other provision of this Ordinance. All Ordinances in conflict herewith are hereby repealed to the extent of such conflict.
SECTION 4
This Ordinance shall be in full force and effect from and after its adoption and publication in pamphlet form as provided by law.
