History

PROJECT:

Charleton Highlands Subdivision (formerly Sheffield Highlands), located at the southwest corner of 163rd Street and 94th Avenue, was approved by the Village Board on July 6, 2005 as a Planned Development with 23 detached single-family units.  The subdivision is currently under construction, with two units in the ground.

 

On October 23, 2007, the petitioner requested variances to reduce the rear yard setbacks for lots 17, 18, and 19, and appeared before Plan Commission with this proposal.  When Plan Commission expressed concerns with that proposal, the petitioner suggested this alternative that is before you tonight.  Both petitions are before the Plan Commission for consideration at this time.

REQUESTED ACTION:

The petitioner has submitted a request to re-subdivide Charleton Highlands Planned Development.  The changes focus on lots 17, 18, and 19.  At the November 27, 2007 Plan Commission, the petitioner had requested approval of a variance to reduce rear yard setback requirements on lots 17, 18, and 19.  The public hearing for the variance was continued to December 11, 2007.

 

On December 11, 2007 the Plan Commission moved 7-0 to recommend to the Village Board approval of the requested Resubdivision for Charleton Highlands Subdivision, as illustrated on the “Charleton Highlands Re-Subdivision II, Survey No. 03-08-043-RESUB" by KDC Consultants Inc. and dated October 24, 2007 and revised November 8, 2007 with the following condition:

1.  That the petitioner meet the required setback dimensions, required on the previously-approved variance.

 

And

Moved to terminate the original variance request.

 

Since the December 11, 2007 Plan Commission, the following issues have been addressed:

1.  A revised “Concept Sketch for Charleton Highlands” has been submitted by the petitioner showing how the proposed houses will comply with the setback requirements.  It appears that no setback modifications or variances will be triggered by the new re-subdivision as shown.  This meets the condition for approval set by the Plan Commission.

 

The proposed re-subdivision will increase the length of the lots by an average of several feet.  It will move the rear property line slightly closer to the detention area, but will more clearly define the private property line, aligning it with the existing retaining wall.  The re-subdivision increases the amount of retaining wall that falls on private property; however parts of the retaining wall were already located on private property.  Charleton Highlands is a planned development with a Homeowner’s Association that provides common maintenance.

 

On January 28, 2008  the Development Services and Planning Committee moved to  recommend to the Village Board approval of the Re-subdivision for Charleton Highlands Subdivision, as illustrated on the “Charleton Highlands Re-Subdivision 2, Survey No. 03-08-043-RESUB" by KDC Consultants Inc. and dated October 24, 2007 and revised November 8, 2007.

 

This is now before the Village Board for consideration.

 

An updated (December 12, 2007) Re-subdivision Plan has been submitted that does not show the retaining walls along the pond.  Retaining walls are not typically shown on Subdivision Plans.

I move to approve the Resubdivision for Charleton Highlands Subdivision, as illustrated on the “Charleton Highlands Re-Subdivision 2, Survey No. 03-08-043-RESUB" by KDC Consultants Inc. and dated October 24, 2007 and revised December 12, 2007.
