An Ordinance Amending Title 9 Chapter 15 - Recommended Ordinance Amendment
History
The Village Board has approved increasing the minimum fine for "General Violations" and " Traffic Compliance" violation fines from $50.00 to $60.00.
In addition, we are recommending to encourage violators to pay their fine(s) in a more timely manner by modifying the current fine and penalty payment (schedule A, 9-15-9-1) and add two new steps (#2 and #4) which are as follows:
Step 1 $60.00 $60.00
Step 2 $100.00 $100.00
Step 3 $150.00 $150.00
Step 4 $200.00 $200.00
Step 5 $250.00 $250.00
Step 2 If the fine is not paid by or at the first hearing date but before the commencement of the 2nd hearing date, the fine amount due will be $100.00
Step 4 If the fine is not paid by or at the 2nd hearing date but before the commencement of the 3rd hearing date, the fine amount due will be $200.00.
On December 6, 2010, this item was reviewed and approved by the Finance Committee and referred to the Board for approval.
Financial Impact
The fine increase and schedule adjustments may increase revenue from this by approximately $150,000.00
Recommended Action/Motion
I move to recommend to the Village Board to pass an Ordinance entitled: AN ORDINANCE AMENDING TITLE 9, CHAPTER 15 OF THE ORLAND PARK VILLAGE CODE (ADMINISTRATIVE ADJUDICATION OF VEHICULAR STANDING, PARKING AND COMPLIANCE VIOLATIONS)
Body
WHEREAS, the Corporate Authorities of the Village of Orland Park, an Illinois home rule municipality, deem it in the best interests of the Village and its residents to amend the Orland Park Village Code with regard to the fine payment schedule of the Village’s administrative adjudication of vehicular standing, parking and compliance violations to ensure that it affords due process to all defendants.
NOW, THEREFORE, Be It Ordained by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, an Illinois home rule municipality, as follows:
SECTION 1
Title 9, Traffic, Chapter 15, Administrative Adjudication of Vehicular Standing, Parking and Compliance Violations, Section 9-15-9-1: Schedule, is amended by deleting Fine and Penalty Payment Schedule A in its entirety, and inserting in its place the following language, to read in its entirety as follows:
“FINE AND PENALTY PAYMENT SCHEDULE A
GENERAL
VIOLATION TRAFFIC
SCHEDULE AMOUNT COMPLIANCE
Step 1 Upon service of a ‘Violation Notice’ issued
and paid prior to the commencement of the
1st Hearing Date, or on the 1st Hearing Date,
the fine will be: $ 60.00 $ 60.00
Step 2 If the fine is not paid by or at the first Hearing
Date, but before the commencement of the 2nd
Hearing Date, the fine amount will be: $100.00 $100.00
Step 3 Having failed to pay the fine amount specified
in Step 2 prior to the commencement of the
2nd Hearing Date, the amount due if paid on
the by or on the 2nd Hearing Date, the fine
amount will be: $150.00 $150.00
Step 4 If the fine is not paid by or at the 2nd Hearing
Date but before the commencement of the 3rd
Hearing Date, the fine amount due will be: $200.00 $200.00
Step 5 Having failed to pay the fine amount and
penalty specified in Step 4 prior to the
commencement of the 3rd Hearing Date,
the amount due, if paid on the 3rd Hearing
Date or upon the finding of liability for
the violation, after failure to appear at
the 3rd Hearing, the fine amount will be: $250.00 $250.00
SECTION 2
All other parts of Chapter 15 not specifically changed by this Ordinance shall remain unchanged and effective. All ordinances in conflict with this Ordinance are hereby repealed to the extent of the conflict.
SECTION 3
If any section, subsection, clause, or phrase of this Ordinance is for any reason held to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this Ordinance.
SECTION 4
This Ordinance shall be in full force and effect from and after its passage, approval and publication as required by law.
SECTION 5
The Village Clerk is hereby ordered to publish this Ordinance in pamphlet form, such pamphlets to be available to the general public at the Village Clerk’s office.
