ORDINANCE AMENDING THE VILLAGE CODE TO ESTABLISH NEW WATER SEWER AND STORMWATER RATES AND CHARGES

WHEREAS, the Corporate Authorities of the Village of Orland Park, Cook and Will Counties, Illinois, are authorized to take such actions as pertain to the government and affairs of the Village; and
WHEREAS, provision of water and sewer service to its citizens and the setting of rates therefore are matters pertaining to the government and affairs of the Village; and
WHEREAS, the Village commissioned a comprehensive water and sewer rate study covering the fiscal years 2008 to 2012 which was presented to the Village Board at its meetings of May 21, 2007 and June 18, 2007; and
WHEREAS, the Corporate Authorities have determined that it is in the best interests of the Village and its residents to provide water rates that have lower unit charges for smaller water usage, thus encouraging water conservation; and
WHEREAS, at the June 18, 2007 regular Village Board meeting, the Board did approve the rates shown below;
NOW, THEREFORE, Be It Ordained by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, an Illinois Home Rule Municipality, as follows:
SECTION 1
The above recitals are hereby incorporated into this Ordinance as fully as if they were restated in this Section in their entirety.
SECTION 2
The Orland Park Village Code, Title 4, Water and Sewer, Chapter 3, Charges and Rates is hereby amended to delete sub-sections 4-3-1-1 and 4-3-1-2 in their entirety and substitute the following:
4-3-1-1: Water and Sewer and Stormwater Service Charges Within Corporate Limits
There shall be and are hereby established charges and rates for the use of and for the service supplied by the combined waterworks and sewerage system of the Village where the premises to which such service and use is furnished are located within the corporate limits of the Village. Use and service for water shall be metered and the bimonthly charges for water, sewer and stormwater service shall be as set forth below. Rates are shown for the fiscal year to which they apply. A fiscal year begins on October 1 and ends on September 30. For example Fiscal Year 2008 begins on October 1, 2007 and ends on September 30, 2008. Bills may be paid by VISA, MASTERCARD and DISCOVER as well as check or cash. A 10% penalty shall be added to all bills not paid by the due date on the bill.

D. Residential lawn-sprinkler-only accounts shall not be required to pay sewer or stormwater charges.

SECTION 3
The rates and charges in Section 2 were approved by this Board of Trustees at the meeting of June 18, 2007 and are effective October 1, 2007, for bills sent out for service provided from October 1, 2007 forward.
SECTION 4
This Ordinance shall be in full force and effect from and after its passage, approval and publication as required by law.
