Title/Name/Summary

ORDINANCE PROVIDING FOR THE ACQUISITION OF RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENT (NE CORNER - 147TH STREET AND RAVINIA AVENUE)

 

Body

WHEREAS, through a grant from the Illinois Department of Transportation (“IDOT”), the Village is preparing to widen and improve the intersection of 147th Street and Ravinia Avenue; and

 

WHEREAS, it is anticipated that such roadway improvements will significantly improve traffic flow through the Village and relieve roadway congestion along Ravinia Avenue and the LaGrange Road corridor; and

 

WHEREAS, to accomplish the roadway widening and improvements, the Village must acquire right-of-way and a temporary construction easement from the owner of the property at the northeast corner of said intersection in the project area; and

 

WHEREAS, it is in the best interest of the Village of Orland Park that this project be completed expeditiously and that obtaining the right-of-way and temporary construction easement from the owner thereof will allow the project to proceed in a timely fashion; and

 

WHEREAS, the Village and the property owner have agreed upon the compensation to be paid by the Village for the right-of-way and temporary construction easement.

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park as follows:

 

SECTION 1

 

The preambles to this Ordinance as set forth above are hereby adopted as the findings of the Village President and Board of Trustees.

 

SECTION 2

 

The purchase of the right-of-way (fee simple title) from the current owner thereof, 14216 SC&B, LLC, an Illinois limited liability company (said right-of-way consisting of 2,850 square feet and legally described in EXHIBIT “A’’ attached hereto and made a part hereof) for the sum of THIRTY-FIVE THOUSAND TWO HUNDRED DOLLARS ($35,200.00) is hereby approved.

 

SECTION 3

 

The purchase of the temporary construction easement, extending for a period of five (5) years, from the current owner of the underlying fee simple title, 14216 SC&B, LLC, an Illinois limited liability company (said temporary construction easement area consisting of 3,713 square feet and legally described in EXHIBIT “B” attached hereto and made a part hereof) for the sum of FIFTEEN THOUSAND DOLLARS ($15,000.00) is hereby approved.

 

SECTION 4

 

The Village President and Village Clerk are hereby authorized and directed to record the Warranty Deed and the Temporary Construction Easement with the office of the Cook County Recorder of Deeds, and the Village Treasurer is authorized and directed to pay the aforesaid compensation to the grantor described in said documents and further, to take all necessary and appropriate action to effectuate the acquisition of said right-of-way and temporary construction easement.

 

SECTION 5

 

This Ordinance shall be effective immediately upon its passage as provided by law.
