RESOLUTION REQUESTING THAT THE VILLAGE OF ORLAND PARK BE TREATED SIMILAR TO NON-CDBG CITIES IN ILLINOIS

Body

WHEREAS, in late 2019, an outbreak of novel coronavirus ("COVID-19") occurred in China and quickly spread across the globe; and

 

WHEREAS, the American Rescue Plan Act was passed and signed into law earlier this year in order to provide a substantial infusion of resources to help turn the tide on the pandemic; and

 

WHEREAS, the Coronavirus State Fiscal Recovery Funds (CSFRF) and Coronavirus Local Fiscal Recovery Funds (CLFRF) are intended to provide substantial flexibility for each government to meet local needs; and

 

WHEREAS, the Village of Orland Park has a population over 50,000, but is not a Community Development Block Grant (CDBG) Entitlement City; and

 

WHEREAS, CLFRF defines Non-Entitlement Units (NEUs) as municipalities that are not CDBG Entitlement Cities and have a population below 50,000; and

 

WHEREAS, the CLFRF program treats cities and villages that have a population over 50,000 and are not CDGB entitlement cities different than NEUs with a population below 50,000; and

 

WHEREAS, NEUs have been allocated funding on a per capita basis of $135.94 per person; and

 

WHEREAS, the funding formula for Metropolitan Cities provides funding based on CDBG Funding formulas, which factor in poverty, population, housing overcrowding and age of house; and

 

WHEREAS, the Village of Orland Park has low poverty, low housing overcrowding, and has relatively new housing stock compared to CDBG Entitlement Cities, and therefore does not qualify to be a CDBG Entitlement City; and

 

WHEREAS, using the CDBG funding formula to allocate funds for municipalities with a population over 50,000 that do not qualify for CDBG funding is fundamentally unfair; and

 

WHEREAS, thirty-five (35) of Illinois’ Metropolitan Cities have been allocated more than $135.94 per person, some up to $1,395.63 per person; and

 

WHEREAS, eleven (11) of Illinois’ Metropolitan Cities have been allocated less than $135.94 per person, including Orland Park at $86.59 per resident, which is the lowest per capita allocation of any Metropolitan City in the State of Illinois; and

 

WHEREAS, the Village of Orland Park has been allocated $5,004,738 using the CDBG formula instead of $7,856,652.30 using the per capita formula with 2019 census estimated population for NEUs, and shortfall of $2,851,914.30; and

 

NOW, THEREFORE, BE IT RESOLVED, by the Village President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION I

 

The above recitals are incorporated by reference into this Section I and made a part hereof as though fully set forth herein.

 

SECTION 2

 

The Village President and Board of Trustees of the Village hereby request that the Village of Orland Park be treated like other non-CDBG cities and villages with a population under 50,000.

 

SECTION 3

 

The Village President and Board of Trustees of the Village hereby further request that the State of Illinois make the Village of Orland Park whole and provide CSFRF or other funding in the amount of $2,851,914.30.

 

SECTION 4

 

All ordinances, resolutions, motions or parts thereof in conflict with this Resolution shall be and the same are hereby repealed to the extent of such conflict.
