AN ORDINANCE AMENDING TITLE 8, CHAPTER 6, OF THE ORLAND PARK VILLAGE CODE REGARDING UNAUTHORIZED PRESENCE IN SCHOOLS

 

Body

 

WHEREAS, the Village of Orland Park, Cook and Will Counties, Illinois (the “Village”) is an Illinois home rule municipality; and

WHEREAS, the Village President and Board of Trustees of the Village have the statutory and home rule authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and to protect the public health, safety and welfare of its citizens; and

 

WHEREAS, it is in the best interests of the health, safety and welfare of the public to regulate  the presence of unauthorized individuals within school buildings while students are present to protect students, teachers, administrative staff and other school employees from the dangers associated within unauthorized individuals being present within school buildings

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, pursuant to the Village’s home rule powers, as follows:

 

SECTION 1

 

The above recitals are incorporated herein by reference as though fully set forth herein.

 

SECTION 2

 

Title 8, Chapter 6, is amended by adding a new subsection 8-6-1-11 which shall read in its entirety as follows:

“8-6-1-7:  UNAUTHORIZED PRESENCE IN SCHOOLS.

A.                      It shall be unlawful for any student who is under suspension, expulsion, exemption or other discipline excluding the student from attending school, or for any person, not a student, not a school employee or not a parent or guardian of a student or not an otherwise “authorized person” to be present within any school building without first having secured authorization to be present within a school building from the principal or person in charge of the school, except while in direct route to secure such authorization. Authorized persons shall include any person who is present within any school building for any purpose previously authorized by the principal or person in charge of a school. 

 

B.                     It shall be unlawful for any person, including without limitation student(s) and/or school employee(s) to knowingly allow, facilitate, aid or abet  unauthorized persons to enter a school building without first receiving authorization from the principal or person in charge of said school.

C.                     The term "student," as used herein, is hereby defined as any person of school age and enrolled in the school at which he or she then is present.

D.                     Penalty. Any person who violates the provisions of this section, upon conviction thereof, shall be fined according to the fine schedule located in Appendix B for this and subsequent or continuing violations.”

 

SECTION 3

 

“APPENDIX B - FINE SCHEDULE” of the Orland Park Village Code is hereby amended as follows:

Except as provided in this Section 3, the remaining provisions of “APPENDIX B - FINE SCHEDULE” shall remain unchanged and in full force and effect.

 

SECTION 4

 

This Ordinance shall be in full force and effect from and after its adoption and publication as provided by law.
