Title

AN ORDINANCE VACATING A PLAT OF SUBDIVISION (DEER HAVEN SUBDIVISION, 143RD STREET EAST OF WOLF ROAD) AND APPROVING A NEW PLAT OF SUBDIVISION (DEER HAVEN ESTATES)

 

Body

WHEREAS, a plat of subdivision of the land comprising Deer Haven Subdivision was recorded by the Cook County Recorder’s office on October 15, 2004 as document number 0428934002, and the land was subsequently annexed to the Village of Orland Park; and

 

WHEREAS, the Board of Trustees of the Village of Orland Park have determined that the plat of Deer Haven Subdivision should be vacated and a new subdivision of the land (including some additional adjacent land) known as Deer Haven Estates should be recorded; and

 

WHEREAS, the Board has determined that such vacation of a plat and approval of a new plat of  subdivision is in the best interests of the Village; and

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

The recitals set forth above are hereby incorporated into this Section as fully as if restated herein in their entirety.

 

SECTION 2

 

The Board of Trustees of the Village of Orland Park hereby approves the vacation of the plat of subdivision of the land legally described as follows:

 

ALL OF DEER HAVEN SUBDIVISION, BEING A SUBDIVISION OF PART OF THE NORTHWEST QUARTER OF SECTION 8, TOWNSHIP 36 NORTH, RANGE 12 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED OCTOBER 15, 2004, AS DOCUMENT NUMBER 0428934002 IN COOK COUNTY, ILLINOIS.

 

SECTION 3

 

The Village shall cause the Plat of Vacation, attached hereto as Exhibit A, to be recorded with the Cook County Recorder’s office.

 

SECTION 4

 

The Board of Trustees hereby approves a Plat of Subdivision of the land vacated above and including the five acres adjacent to the west, together known as Deer Haven Estates and legally described as follows:

 

ALL OF DEER HAVEN SUBDIVISION, BEING A SUBDIVISION OF PART OF THE NORTHWEST QUARTER OF SECTION 8, TOWNSHIP 36 NORTH, RANGE 12 EAST OF THE THIRD PRINCIPAL MERIDIAN, ACCORDING TO THE PLAT THEREOF RECORDED OCTOBER 15, 2004, AS DOCUMENT NUMBER 0428934002 IN COOK COUNTY, ILLINOIS.

 

And

 

THE WEST FIVE ACRES OF THE EAST 17 ACRES OF THE WEST 34 ACRES OF THE NORTH 60 ACRES OF THE NORTHWEST QUARTER OF SECTION 8, TOWNSHIP 39 NORTH, RANGE 12 EAST OF THE THIRD PRINCIPAL MERIDIAN (EXCEPT RITHTS OF PUBLIC, THE MUNICIPALITY AND THE STATE OF ILLINOIS IN AND TO THAT PART TAKEN FOR ROADS AND HIGHWAYS) IN COOK COUNTY, ILINOIS.

 

SECTION 5

 

The Village shall cause the Plat of Subdivision of Deer Haven Estates attached hereto as Exhibit B, to be recorded with the Cook County Recorder’s office.

 

SECTION 6

 

All ordinances or parts of ordinances in conflict with this Ordinance are to the extent of such conflict hereby repealed and each section, paragraph, clause and provision of this ordinance is separable and if any provision is held unconstitutional or invalid for any reason, such decision shall not affect the remainder of this ordinance, nor any part thereof, other than that part affected by such decision.

 

SECTION 7

 

This Ordinance shall be in full force and effect from and after its passage and publication according to law.
