Title

AN ORDINANCE AMENDING TITLE 2, CHAPTER 8, OF THE ORLAND PARK VILLAGE CODE REGARDING THE VETERANS COMMISSION

Body

                     WHEREAS, the President and Board of Trustees of the Village of Orland Park have from time to time created by ordinance certain commissions, committees and advisory boards in order to provide the President and Board of Trustees with information, advice and technical assistance on certain matters to come before the President and Board of Trustees, and

 

                     WHEREAS, as these commissions, committees, and advisory boards have operated, it has become clear that certain structural changes would be in the best interests of the efficient operation of these boards and commissions and would further their overall mission; and

 

                     WHEREAS, the President and Board of Trustees of the Village of Orland Park, in cooperation and consultation of Village staff and the members of the Veterans Commission, have determined that changes to the Board’s composition and duties are in the best interest of the Village and its residents; and

 

                     WHEREAS, the President and the Board of Trustees of the Village of Orland Park find that it is in the best interest of the Village and its residents to amend the Village Code to promote the efficient operation of the Veterans Commission.

 

                     NOW, THEREFORE, BE IT RESOLVED, by the Village President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

 

SECTION 1

 

The above recitals are incorporated by reference into this Section 1 and made a part hereof as though fully set forth herein.

 

 

SECTION 2

 

Title 2, Chapter 8, Section 2-8-2 of the Orland Park Village Code is hereby amended by deleting Section 2-8-2 in its entirety and replacing it as follows:

 

2-8-2:                     MEMBERSHIP; TERM; COMPENSATION:

 

                     The Commission shall consist of nine (9) members to be appointed by the Village President and with the advice and consent of the Board of Trustees, and one (1) non voting Village staff member (the "Veterans Program Assistant") appointed by the Village Manager to act as staff liaison and recording secretary.  The nine voting members must be residents of the Village of Orland Park or members of the American Legion Post 111 or Orland/Palos VFW Post 2604.

 

1.                     Members shall serve for one year terms, which shall begin on the first Monday in June and expire on the first Monday in June of the following year. Members shall be selected on the basis of experience and/or knowledge of veteran affairs and concerns, and the members shall have served in one of the American military branches and have been honorably discharged. Members shall serve without compensation.

 

2.                     Duties of Members of the Veterans Commission shall include attending all scheduled and called meetings, and supporting the activities of the Veterans Commission, being willing and able to serve at least four hours per month in this capacity.

 

3.                     If any member shall fail to attend four (4) regular meetings within any one year period, or fail to serve their four hours of monthly duties more than four (4) times within any one year period without reasonable excuse, such failure shall constitute sufficient grounds for termination of the member's appointment. The chairman shall immediately file notification of nonattendance with the Village Clerk for placement on the agenda of the Board of Trustees, and the Board shall, after notice to the member, by appropriate action, consider whether to terminate the member's appointment. If the decision of the Board is to terminate the appointment, the vacancy thereby created shall be filled as soon as reasonably practical.

 

4.                     A special meeting may be called by the Village President or by request of three (3) Commission members.

 

5.                     A quorum may be the majority of the actually appointed members.

 

6.                     The chairman shall be a member designated, at the time of appointment, by the Village President.

 

7.                     Any expenditures shall only be those sums as may be approved by the President and Board of Trustees.

 

 

SECTION 3

 

Section 2-8-3 (Goals) of Chapter 8 (Veterans Commission) of Title 2 (Boards and Commissions) of the Village Code is hereby amended to add a new subparagraph 6 as follows:

 

                     “6.                     Perform other functions and actions, in keeping with the spirit of this Ordinance, as directed and approved by the Village President and the Board of Trustees.”

 

 

SECTION 4

 

Section 2-8-4 (Duties) of Chapter 8 (Veterans Commission) of Title 2 (Boards and Commissions) of the Village Code is hereby amended to delete Subparagraph 1 and replace it with the following:

 

1.                     Study and consider possible activities, informational, educational and recreational, which may be planned by the Village relating to Veterans’ affairs, and support of service personnel on active duty, including the National Guard and reserve forces.

 

 

SECTION 5

 

Section 2-8-6 (Ex Officio Member) of Chapter 8 (Veterans Commission) of Title 2 (Boards and Commissions) of the Village Code is hereby created to read as follows:

 

“2-8-6:  EX OFFICIO MEMBER:  Any appointed member of the Veterans Commission, having served at least five years on the Veterans Commission, who is no longer able to perform the duties expected of them, as enumerated in this ordinance, will be invited to become an Ex Officio member of the Orland Park Veterans Commission.  Ex Officio members are invited to attend all Veterans Commission meetings and activities, and to provide input to items under discussion by the Veterans Commission.  Ex Officio members do not have the authority to vote on items under consideration by the Veterans Commission.  

 

 

SECTION 6

 

All Ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.

 

 

SECTION 7

 

If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this Ordinance.

 

 

SECTION 8

 

This Ordinance shall be in full force and effect from and after its adoption and publication as provided by law.
