History

The Village has received a request for a variance to the Village Code as amended (5-1-13 item 47  Exception #1 attached).  This project is existing, and located at 7250 W. 157th Street under Building Permit # 06-297. (near Harlem Ave). 

 

This request is to vary the types of materials required for the detached garage buildings when located at 10’-0” from a lot lines.

 

 The code section noted above allows wood frame exterior wall construction (studs) for multi-family detached garages when located 15’- 0” from the lot lines.  The existing plan has designed the detached garages 10’-0” for the lot lines.  The variance is to allow wood frame (stud) exterior walls at 10’-0” from the lot lines these detached garages.

 

The existing permit is part of the 27 unit “Orland Cove Condominiums” which are not completed or occupied at this time.   The architectural plans for the detached garages show a 2-hour fire rated 6” solid masonry exterior block wall supporting the face brick.  

 

Plan revisions with a 2-hour fire rated assembly shall be submitted by the land owner’s/agent architect (Shalvis Group) before approval by the Building Official.

This building is currently under construction within the Village. The Village of Orland Park currently utilizes the 2006 Edition of the International Building Code with amendments (Village Code 5-1-13).  Our existing ordinance has amendments to the adopted model code (noted above) to prohibit wood frame construction unless the detached garages are at least 15 feet from the lot lines.

 

A wood frame exterior wall construction would be permitted by the International Building Codes with restrictions on minimum lot line setbacks similar to the Village Of Orland Park’s ordinance.  This change would meet the requirements of the model code without our amendments.  

 

If approved by the Village Board, this construction material code change would be approved by the Development Services Department with the conditions listed above. Village has no staff objection as long as all conditions are met by the petitioner.  This local amendment is under review as part of the larger Village Code Amendment discussion on tonight's agenda.

 

I recommend to the Village Board approval of a variance allowing wood frame construction for garages at 10 feet from the lot lines.
