Title

AN ORDINANCE AUTHORIZING DISPOSAL BY PUBLIC AUCTION OF PERSONAL PROPERTY (81 USED CELL PHONES) OWNED BY THE VILLAGE OF ORLAND PARK, ILLINOIS

Body

WHEREAS, the Village of Orland Park is the owner of personal property (81 used cell phones) described in EXHIBIT A attached hereto and incorporated herein by reference; and

 

WHEREAS, the Corporate Authorities of the Village of Orland Park have determined it is no longer necessary, useful or in the best interest for the Village of Orland Park to retain ownership of the personal property (81 used cell phones) described in EXHIBIT A attached hereto; and

 

WHEREAS, the President and Board of Trustees of the Village of Orland Park have determined that the said personal property shall be sold, if possible, through public auction on Muncibid.com, a free online auction website for government agencies to sell no longer need items, surplus and forfeitures directly to public.  The website makes bidding available 24 hours a day, is easy-to-use and allows for national sales exposure.

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Illinois, as follows:

 

SECTION 1

 

The above recitals are hereby incorporated into this section as fully as if they were set forth herein in their entirety.

 

SECTION 2

 

Pursuant to Section 11-76-4 of the Illinois Municipal Code, Illinois Compiled Statutes, 65 ILCS 5/11-76-4, the President and the Board of Trustees of the Village of Orland Park find that the items of personal property listed on EXHIBIT A (81 used cell phones) now owned by the Village of Orland Park, Illinois, are no longer necessary or useful to the said Village and its best interests will be served by disposal by online public auction of such 81 used cell phones.

 

SECTION 3

 

Pursuant to the said Section 11-76-4, the Village Manager is hereby authorized to and may direct the disposal of the personal property to which Section 2 of this Ordinance refers “AS-IS” without warranties of any kind.  In particular, the Village of Orland Park makes no warranties or representations expressed or implied about the performance ability of the equipment, about its present state of repair, about its condition or maintenance, or its merchantability or fitness for a particular purpose.  Upon completion of bidding, the Village will require the winning bidder to complete a Surplus Equipment Online Public Auction Affidavit attached hereto.

 

SECTION 4

 

The Village Purchasing Administrator is hereby authorized and directed to advertise the sale of the aforementioned personal property (81 used cell phones) on Municibid.com.

 

SECTION 5

 

No bid which is less than the minimum price as provided by the Village Purchasing Administrator to Municibid.com shall be accepted by Municibid.com as the sales price of property listed in EXHIBIT A of this Ordinance unless a lower amount is authorized by the Village Manager or his/her representative.

 

SECTION 6

 

Upon payment of the full price, the Village Manager and/or Village President is hereby authorized and directed to convey and transfer title or ownership to the item of personal property from the Village to the successful bidder/buyer and to execute all documents necessary to effectuate the sale.

 

SECTION 7

 

In the event that, after no fewer than two (2) attempts have been made by Municibid.com to sell said personal property, no bids have been received equal to the minimum price as determined in the manner set forth above, the said personal property shall be either donated or scrapped as determined by the Village Manager.

 

SECTION 8

 

This Ordinance shall be in full force and effect from and after its passage by a majority vote of the Corporate Authorities and approval in the manner provided by law.
