AN ORDINANCE AMENDING TITLE 3, CHAPTER 1, SECTION 12 AND ADDING A NEW TITLE 3, CHAPTER 1, SECTION 13 OF THE ORLAND PARK VILLAGE CODE REGARDING USE OF THE VETERANS BUILDING AT 14671 WEST AVENUE

WHEREAS, the Village President and Board of Trustees of the Village of Orland Park (the “Village”) have the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and to protect the public health, safety and welfare of its citizens; and

 

WHEREAS, a Village building such as the Veterans Center, located at 14671 West Avenue, is used in part by the Village and in part by groups and organizations for the benefit of the community, and specifically Veterans, and the Village must ensure that all users follow rules to ensure the safety, enjoyment, and preservation of the Village’s buildings and resources; and

 

WHEREAS, in light of the above stated aims, the Village President and Board of Trustees find that the usage of the Veterans Center should be guided by a consistent usage policy; and

 

WHEREAS, it is in the best interests of the health, safety and welfare of the citizens and residents of the Village that usage of the Village’s Veterans Building be regulated.

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1:

 

The above recitals are incorporated herein by reference as though fully set forth herein.

 

SECTION 2:

 

Title 3, Chapter 1, Section 12 of the Orland Park Village Code is deleted in its entirety and replaced by the following:

 

“3-1-12:  VETERANS BUILDING AND USE:

 

A.                     Veteran’s Organizations

 

Veterans’ Organizations may be permitted to use the Village’s Veterans’ Center, located at 14671 West Avenue, in limited circumstances.  A Veterans’ Organization shall be defined as the following: a post or organization with at least seventy-five percent (75%) of its members being past or present members of the United States Armed Forces, operated exclusively for one or more of the following purposes:  to assist disabled and needy war veterans and members of the United States Armed Forces; to provide entertainment, care, and assistance to hospitalized veterans or members of the United States Armed Forces; to carry on programs to perpetuate the memory of deceased veterans and members of the United States Armed Forces and comfort their survivors; to conduct programs for charitable, or educational purposes; to sponsor or participate in activities of a patriotic nature; or to provide social and recreational activities for members.  For any organization recognized as a Veterans’ Organization under this section, no part of its net earnings may inure to the benefit of any private shareholder or individual.

 

B.                     License Agreement

 

When any Veterans’ Organization seeks regular use and/or access to the Village’s Veterans Center located at 14671 West Avenue, it must enter into a License Agreement with the Village setting forth the terms and conditions of its access and usage.  The Village shall set a limit on the number of organizations licensed based on the building’s capacity as well as the Village’s needs.  The current limit shall be four (4) licensed organizations.  If the Village considers additional license agreements in the future, it shall consider the usage needs of both the Village and existing licensed organizations, and priority shall be given to current users. 

 

C.                     Building Usage

 

1.                     Access.  Building access to the Veterans’ Center shall be limited to members of licensed Veterans’ Organizations according to the terms of their License Agreement; the Chair of the Veterans’ Commission; the Orland Park Veterans Service Officer; Village Manager and Village staff or volunteers as approved by the Village Manager; and the Mayor.  Keys (or key card access) to the building shall be provided to the American Legion Post #111 Commander, VFW Post #2604 Commander, Veterans Commission Chairman, Village Veteran’s Service Officer, Village Manager, Village Employees and contractors designated by the Village Manager and the Mayor.

2.                     Storage.  Storage space shall be provided to members of licensed Veterans’ Organizations according to the terms of their License Agreement, as well as to the Village of Orland Park.  If an organization who has storage privileges pursuant to their License Agreement wishes to extend such privileges to any affiliated organization, the affiliate must have permission of the sponsoring organization as well as a license agreement with the Village of Orland Park.

3.                     Usage by Affiliate Organizations.  Organizations affiliated with a Licensed Veterans’ Organization may use the building if approved by the sponsoring organization and the affiliate organization enters into an Access Agreement with the Village of Orland Park.”

 

SECTION 3:

Title 3, Chapter 1, of the Orland Park Village Code shall be amended by adding a new Section 3-1-13 as follows:

 

“3-1-13  EXCEPTION TO REGULATIONS:

 

The foregoing regulations shall not prohibit the performance of the lawful employment duties by Village employees.


SECTION 4:

This Ordinance shall be in full force and effect from and after its adoption, approval and publication in pamphlet form as provided by law.
