ORDINANCE REZONING PROPERTY AND AMENDING A SPECIAL USE FOR A PLACE OF WORSHIP (PARKVIEW CHRISTIAN CHURCH PARKING LOT EXPANSION)

 

Body

WHEREAS, a petition for rezoning property and amending a special use permit for certain real estate, as set forth below, has been filed with the Village Clerk of this Village and said petition has been referred to the Plan Commission of this Village and has been processed in accordance with the Land Development Code of the Village of Orland Park as amended (the "Code"); and

 

WHEREAS, said Plan Commission of this Village held a public hearing on March 11, 2008, on whether the requested rezoning and special use amendment should be granted, at which time all persons present were afforded an opportunity to be heard; and

 

WHEREAS, a public notice in the form required by law, was given of the public hearing by publication not more than thirty (30) days nor less than fifteen (15) days prior to said meeting in the Southtown Star, a newspaper of general circulation in this Village, there being no newspaper published in this Village; and

 

WHEREAS, the Plan Commission of this Village has filed its report of findings and recommendations that the requested rezoning and special use amendment be granted with this President and Board of Trustees, and this Board of Trustees has duly considered said report and findings and recommendations;

 

NOW THEREFORE, Be It Ordained by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

The report and findings and recommendations of the Plan Commission of this Village regarding the proposed rezoning and special use amendment are herein incorporated by reference as the findings of this President and Board of Trustees, as completely as if fully recited herein at length.  All exhibits submitted at the aforesaid public hearings are also hereby incorporated by reference as fully as if attached hereto.  This President and Board of Trustees further find that the proposed rezoning and amended special use are in the public good and in the best interests of the Village and its residents and are consistent with and foster the purposes and spirit of the Code as set forth in Section 1-102 thereof.  Said rezoning and amended special use are also in accordance with the provi-sions of the Comprehensive Land Use Plan of the Village.

 

SECTION 2

 

In addition to the findings set forth in Section 1 hereof, this Board of Trustees further finds, in relation to the proposed rezoning and amendment to a special use permit for a place of worship in the E-1 Estate Residential District, to rezone and include in the permit an additional four (4) acres of land with an additional two hundred ninety-seven (297) parking spaces on the rezoned parcel as follows:

 

A.  Parkview Christian Church began at this location in 2001 as a 24,000 square foot building.  It now has an 88,000 square foot building on approximately 12 acres of land.  It now seeks to increase its parking lot by adding a 4 acre parcel to the east of the Church Property, rezoning the parcel from ORI to E-1 and including the parcel in its amended Special Use Permit for a place of worship in the E-1 District.  The existing Church Property is located within the Village of Orland Park in Cook County, Illinois, generally at the northeast corner of 183rd Street and Wolf Road, in the E-1 District.  The Subject Property is a 4-acre parcel immediately to the east of the Church Property.  The church parking lot currently accommodates seven hundred fifty-eight (758) vehicles and the overall Church Property currently has a 62.1% lot coverage.

 

B.  The proposed use of the additional 4 acres comprising the Subject Property is consistent with the purposes, goals, objectives and standards of the Comprehensive Plan, any adopted overlay plan and the Code.  The Comprehensive Plan designates this property as Planned Mixed Use Commercial Residential.  An expanded parking lot for a church is appropriate in such an area.

 

C.  The Subject Property is zoned ORI Office Research Industrial District, but rezoning to E-1 Estate Residential District is requested to include the Subject Property in the special use permit for the overall Church Property.  Permitting the requested additional parking on the Subject Property requires modification of the parking standards for places of worship, contained in Table 6-306 (B) of the Land Development Code of the Village and amended for the Subject Property by previous ordinances. Two other modifications to the requirements of the Village’s Land Development Code are also requested.

 

D.  Specifically, an increase from five hundred sixteen (516) permitted parking spaces to one thousand fifty-five (1,055) overall spaces is requested, as well as a modification in the lot coverage allowed, to increase the current 62.1% coverage to 69.3%, and a reduction in the number of required landscape islands in the new 4-acre parking lot from 42 to 22.

 

E.  Allowing the modifications indicated above will increase the ability of the overall special use for the Church to meet the general standards for all special uses.  It will reduce the adverse effects on adjacent properties by providing more on-site parking and reducing traffic in the area and the likelihood that the Church’s congregation will park in the residential areas nearby and walk to the Church or create traffic congestion by parking on-street on 183rd Street or Wolf Road.

 

F.  The proposed amended special use for the Church Property and development of the Subject Property will be consistent with the character of the immediate vicinity of the Subject Property.  Open space in the ORI District exists to the East; R-4 Residential property (Fountain Hills Subdivision) exists to the North of the existing church; additional ORI zoned property exists to the North of the Subject Property.  Across 183rd Street, oil storage tanks exist to the South.  To the West of the Subject Property is the existing Church Property, then, across Wolf Road, is R-3 Single Family Residential (Preserve of Marley Creek).  An expanded parking lot for a church can be consistent with this varied character of the immediate vicinity.

 

G.  The proposed use of the Subject Property minimizes adverse effects, including visual impacts, on adjacent properties.  Landscaping will exist in and around the area where the increased parking will be located.  This will help reduce the visual expanse of asphalt on the property.  The proposed amended special use will not adversely affect the value of adjacent property, but by reducing traffic congestion, may enhance that value.

 

H.  The petitioner has demonstrated that public facilities and services, including but not limited to roadways, police and fire protection, hospital and medical services, drainage systems, refuse disposal, water and sewers, will be capable of serving the amended special use at an adequate level of service.  Adequate measures have been or will be taken to provide ingress and egress so designed to minimize traffic congestion in the public streets.  The entrances and exits continue to comply with all applicable requirements, and internal traffic is adequately provided for.  At a later date, sidewalks should be provided.

 

I.  Petitioner has made adequate legal provision to guarantee the provision and development of any open space and other improvements associated with the proposed development.

 

J.  The proposed special use amendment does not adversely affect a known archaeological, historical or cultural resource.

 

K.  The proposed special use amendment shall comply with all additional standards imposed on it by all other applicable requirements of the ordinances of the Village.

 

SECTION 3

 

The zoning map of the Village of Orland Park, as amended, is hereby further amended to rezone the Subject Property legally described below from ORI Office Research Industrial District to E-1 Estate Residential District.  The Subject Property is legally described as follows:

 

THAT PART OF THE EAST HALF OF THE SOUTHWEST QUARTER AND THE SOUTHEAST QUARTER OF SECTION 32, TOWNSHIP 36 NORTH, RANGE 12 EAST OF THE THIRD PRINCIPAL MERIDIAN DESCRIBED AS FOLLOWS:  COMMENCING AT THE NORTHWEST CORNER OF SAID EAST HALF OF THE SOUTHWEST QUARTER OF SECTION 32; THENCE SOUTH 0° 11’ 26” WEST ALONG THE WEST LINE OF THE SAID EAST HALF OF THE SOUTHWEST QUARTER OF SECTION 32 FOR A DISTANCE OF 1053.33 FEET TO THE POINT OF BEGINNING; THENCE SOUTH 51° 31’ 23” EAST FOR A DISTANCE OF 1763.72 FEET; THENCE SOUTH 40° 33’ 43” EAST FOR A DISTANCE OF 604.05 FEET TO THE NORTH LINE OF 183RD STREET, SAID LINE LYING 50.00 FEET NORTH OF AND PARALLEL TO THE SOUTH LINE OF THE SAID SOUTHEAST QUARTER OF SECTION 32; THENCE NORTH 89° 34’ 54” WEST ALONG THE SAID NORTH LINE OF 183RD STREET FOR A DISTANCE OF 445.11 FEET TO THE WEST LINE OF THE SAID SOUTHEAST QUARTER OF SECTION 32; THENCE NORTH 89° 31’ 56” WEST CONTINUING ALONG THE SAID NORTH LINE OF 183RD STREET SAID LINE LYING 50.00 FEET NORTH OF A ND PARALLEL TO THE SOUTH LINE OF THE SAID WEST HALF OF THE SOUTHWEST QUARTER OF SECTION 32 FOR A DISTANCE OF 1333.62 FEET TO THE SAID WEST LINE OF THE EAST HALF OF THE SOUTHWEST QUARTER OF SECTION 32; THENCE NORTH 0° 11’ 26” EAST ALONG THE SAID WEST LINE OF THE EAST HALF OF THE SOUTHWEST QUARTER OF SECTION 32 FOR A DISTANCE OF 1542.16 FEET TO THE POINT OF BEGINNING, ALL IN COOK COUNTY,

ILLINOIS.

 

SECTION 4

 

A further amendment to an amended special use for a place of worship in the E-1 District is hereby granted to add the four (4) acre parcel legally described above (the Subject Property) to an existing Church Property to increase the amount accessory parking available to the Church by two hundred eighty-seven (287) spaces for a total of one thousand fifty-five (1,055) parking spaces on the combined Subject Property and existing Church Property. 

 

This further amendment to the amended special use permit for the Parkview Christian Church includes a modification to the permitted lot coverage requirement to allow an overall 69.3% lot coverage and a modification to parking standards to allow one thousand fifty-five (1,055) parking spaces on the Subject Property and the existing Church Property combined, with a reduction in the landscape island requirement from 42 to 22 in the new parking lot and is subject to the following conditions:

 

1.  The parking lot expansion shall be constructed pursuant to the hereby approved preliminary plan titled “Parkview Christian Church,” prepared by Engineering Resource Associates, Inc., dated March 5, 2008, project number 270801, Sheet C-0-0.

 

2.  A Landscape Plan for separate review and approval shall be submitted within sixty (60) days of Village Board approval that not only meets code requirements but also provides an additional twenty (20) trees and forty (40) shrubs (beyond code requirements) within the parking lot buffer areas on existing Church Property.

 

3.  New parking lot lighting shall be installed by November 2, 2008.

 

4.  Petitioner shall submit an “as built” site plan of the existing Church Property to confirm the number of parking stalls prior to the approval of this Special Use Amendment Ordinance.

 

5.  Petitioner shall provide a separate Letter of Credit to cover the cost of extending the watermain and the sidewalk to the east property line of the Subject Property.

 

6.  Petitioner shall extend the sidewalk and the watermain across the Subject Property when the vacant parcel to the east returns for development.

 

SECTION 5

 

The Petitioner hereunder shall at all times comply with the terms and conditions of this amendment, the original special use permit and other amendments, and in the event of non-compliance, said amendments or permit shall be subject to revocation by appropriate legal proceedings.

 

SECTION 5

 

The zoning map of the Village of Orland Park, Cook and Will Counties, Illinois, be amended so as to be in conformance with the rezoning and special use amendment as aforesaid.

 

SECTION 6

 

That this Ordinance shall be in full force and effect from and after its adoption and approval as required by law.
