A RESOLUTION APPROVING AN APPEAL FROM THE PROVISIONS OF THE ORLAND PARK BUILDING CODE REGARDING SPRINKLER SYSTEMS AND FIREWALLS (ST. MICHAEL’S PARISH CENTER)

 

Body

WHEREAS, the Village of Orland Park has adopted the 2006 Edition of the International Building Code (the IBC) with specific amendments as the Orland Park Building Code; and

 

WHEREAS, the Orland Park Building Code Section 102.2.2 (found at item 4 of the Village amendments to the IBC) provides that whenever the floor area of a building is increased by more than 10%, the entire building shall be brought into compliance with the provisions of the Orland Park Building Code; and

 

WHEREAS, the Orland Park Building Code also provides, at Section 705.9 (found at item 63 of the Village amendments to the IBC) that penetrating and cutting of fire walls shall not be permitted; and

 

WHEREAS, the Orland Park Code Official has reviewed a request to vary both of those sections with respect to a planned 13,153 square foot building addition to the St. Michaels Parish Building complex to link the church and school segments of the complex (which addition is a 17.3% increase in the overall building size).  The request is to allow a five-year time frame to bring the entire Parish Building into compliance with the requirement that fire sprinklers be installed in the entire building (both existing and new portions), and during that five year period, to allow fire sprinkler main piping and electrical conduit to extend the emergency lighting and fire alarm systems to penetrate the fire walls between the sprinklered and unsprinklered areas of the expanded Parish Building Complex; and

 

WHEREAS, the Code Official’s review of the requests has determined that the requested variances should be granted with the conditions noted below, in particular because the church and school buildings have existed as individual buildings for decades and the penetrations in the firewalls which will now connect the entire complex as a single building will be minimized and will be fully sealed using approved UL designated designs, which meet the requirements of the IBC although not the more restrictive requirements of the Orland Park Building Code; and

 

WHEREAS, because the Code Official has recommended that the corporate authorities approve the request for variances from the Orland Park Building Code subject to the conditions below and the Building Committee of the Village Board has reviewed the request as well and has recommended permitting such use, the Village Board has determined that the requested variances should be granted.

 

NOW, THEREFORE, Be It Resolved by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

The above provisions are hereby incorporated into this Resolution as fully as if restated in this Section in their entirety.

 

SECTION 2

 

Subject to the conditions enumerated in Section III below, variances from the strict application of Subsections 102.2.2 and 705.9 of the Orland Park Building Code are granted to allow a five (5) year timeline to install a fire sprinkler system in the church and school portions of the St. Michaels Parish Building, and to allow penetrations for fire sprinkler mains and electrical conduit for emergency lighting and fire alarm systems in the new two (2) and three (3) hour firewalls that will be installed as part of the construction project.  These variances are granted for the construction of a 13,153 square foot addition to the existing St. Michaels Parish complex, located at 14327 Highland Avenue in Orland Park, which addition will link the existing church and school buildings.

 

SECTION 3

 

The variances approved in Section II above are conditioned on the five (5) year timeline starting when the Certificate of Occupancy is granted for the new 13,153 square foot addition, and on the existing firewall between the existing school and church areas being continuous.

 

SECTION 4

 

All other requirements of the Orland Park Building Code not specifically varied by this Resolution, shall be met.

 

SECTION 5

 

If any section, paragraph, clause, phrase or part of this Resolution is for any reason held invalid, such decision shall not affect the validity of the remaining provisions of this Resolution.

 

SECTION 6

 

A certified copy of this Resolution shall be provided to the architect for the Parish, Leanne Meyer-Smith, Newman Architecture, 1730 Park Street, Suite 115, Naperville, IL 60563-2611 and to the Orland Park Building Department.

 

SECTION 7

 

This Resolution shall be in full force and effect from and after its adoption, approval and publication as required by law.
