ORDINANCE AUTHORIZING RELEASE (ABROGATION) OF PART OF THE PUBLIC UTILITY AND DRAINAGE EASEMENTS OF LOT 31 IN CREEKSIDE UNIT ONE- 14169 CREEK CROSSING DRIVE

 

Body

WHEREAS, by a Plat of Subdivision, document number 89216015, there was reserved and granted to the Village a public utility and drainage easement over, upon and across the following described property, to wit:

 

The southwesterly 15 feet of lot 31 (except the southeasterly 15 feet thereof) in Creekside Unit 1, being a subdivision in the West 1/2 of the Southeast 1/4 of Section 6, Township 36 North, Range 12, East of the Third Principal Meridian, according to the plat thereof recorded May 11, 1989 as doc. number 89216015 in Cook County Illinois. ; and

 

WHEREAS, the owner of the subject property has requested the Village to release or abrogate the west 5 feet of the 15 foot easement  west line of lot 31, and it has been determined by the Village staff that the Village has no facilities located within said easements, and it is anticipated that the Village will have no future need for said easements;

 

WHEREAS, the owner has obtained the necessary approvals of the utility companies to whom easement rights are reserved and granted

 

WHEREAS, the Board of Trustees of the Village of Orland Park, after due investigation and consideration, has determined that the nature and extent of the public use or public interested to be subserved is such as to warrant the vacation of certain utility and drainage easements situated within the subdivision known as Creekside Unit 1, Lot 31,

 

WHEREAS, the public utility and drainage easements are no longer needed for utility and drainage purposes, and the vacation of such easements will not destroy any rights or privileges of any properties within Creekside Unit 1 Subdivision or otherwise.

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

The Release (Abrogation) of Easement in the form of the Plat of Abrogation attached hereto as Exhibit 1 is hereby approved, and the Village President and Village Clerk are hereby authorized and directed to execute said document on behalf of the Village.  The public interest will be served by such vacation.

 

SECTION 2

 

This Ordinance shall be in full force and effect from and after its passage by an affirmative vote of at least three-fourths (3/4) of the Trustees now holding office and approval in the manner as provided by law.
