Krad Subdivision

History

The petitioner proposes to subdivide his approximately 133,975 square-foot parcel of land into three lots. Lot 1 will be 41,724 square feet. Lot 2 will be 41,881 square feet. Lot 3 will be 23,790 square feet. Following subdivision, the petitioner seeks to rezone the entire site. This conforms to the maximum density of 2 dwelling units per acre in the Comprehensive Plan.

The subject property is currently zoned E-1 Estate Residential, which is the default zoning of a property upon annexation into the Village (annexed in 1994). E-1 is also characterized by very low residential density in areas of “essentially rural character.” The current petitioner has long term plans to construct a house on Lot 1 (the sloping open space) of the subdivision.

The proposed lots would fit within an R-1 Residential District designation. The R-1 designation fits the subdivided lots to be conforming to the Land Development Code.

Plan Commission

On November 27, 2007 the Plan Commission considered this petition and moved to recommend to the Village Board approval of the subdivision as shown on the plat of subdivision titled “Krad Subdivision” prepared by Landmark Engineering Corporation, dated 10-15-07, project number 07-04-119-CPT, subject to the following conditions:

1. That the petitioner work with staff to discuss installation of a sidewalk along the length of Lots 1, 2 and 3 on 108th Avenue and connect to the Collette Highlands sidewalk system to the south and the 153rd Street Wetland sidewalk system to the north at such time development occurs on these lots;

2. That the petitioner provide a tree survey with building footprints at such time as the lots are developed;

3. That the petitioner dedicate to the 108th Avenue right-of-way the necessary 50 feet along the length of Lot 2 of the subdivision, circumventing the building at the west-by-northwest corner of the building, forming a triangle around that corner, and then continuing back to the 50 foot dedication line to match the dedication lines along Lots 1 and 3;

The Plan Commission also moved to recommend to the Village Board approval of the rezoning of the subject lots from E-1 Estate Residential to R-1 Residential District subject to the same conditions as above.

After Plan Commission, the petitioner met condition 3, which was the only condition to meet prior to Village Board review.

Discussion

In the original staff report, the condition for installing the sidewalk was upon subdivision and rezoning approval. The Plan Commission modified the condition to install the sidewalk as development occurs on each proposed new lot. Because development may take a long time to occur and the sidewalks may not be put in and/or completed for a long time, the Village must weigh that situation with the need for a connected pedestrian/ path system in that part of the Village.

As a compromise solution, one option is a timeline added to conditions 1 and 2, essentially clarifying that if development does not occur on these lots within a certain time frame following this approval, then sidewalks should be installed to connect the system. The time frame would be a 3 year period following approval. If within 3 years development has not occurred, the sidewalks should be installed to connect the sidewalk system in the area.

However, the Committee preferred that the entire sidewalk be installed at such time that the first of the three lots is developed.

On December 10, 2007 the Development Services/Planning Committee moved 3-0 to recommend to the Village Board approval of the subdivision as shown on the plat of subdivision titled “Krad Subdivision” prepared by Landmark Engineering Corporation, dated 12-4-07, survey number 07-04-119-SUB-R2, subject to the following conditions:

1. That the petitioner install a sidewalk along the length of Lots 1, 2 and 3 on 108th Avenue and connect to the Collette Highlands sidewalk system to the south and the 153rd Street Wetland sidewalk system to the north at such time as the petitioner develops his first lot;

2. That the petitioner provides a tree survey with building footprints at such time as the lots are developed or within 3 years following this approval, which ever occurs first.

And

Moved to recommend to the Village Board approval of the rezoning of the subject lots from E-1 Estate Residential to R-1 Residential District subject to the same conditions as above.

This is now before the Village Board for consideration.

Recommended Action/Motion

I move to approve the subdivision as shown on the plat of subdivision titled “Krad Subdivision” prepared by Landmark Engineering Corporation, dated 12-4-07, survey number 07-04-119-SUB-R2, subject to the following conditions:

 

1. That the petitioner install a sidewalk along the length of Lots 1, 2 and 3 on 108th Avenue and connect to the Collette Highlands sidewalk system to the south and the 153rd Street Wetland sidewalk system to the north at such time as the petitioner develops his first lot;

 

2. That the petitioner provides a tree survey with building footprints at such time as the lots are developed or within 3 years following this approval, which ever occurs first.

I move to approve the rezoning of the subject lots from E-1 Estate Residential to R-1 Residential District subject to the same conditions as above.
