AN ORDINANCE AMENDING TITLE 5, CHAPTER 2 (BUILDING PERMITS AND FEES) OF THE VILLAGE OF ORLAND PARK, AS AMENDED REGARDING ELEVATOR INSPECTION FEES

WHEREAS, the Corporate Authorities of the Village of Orland Park (Village), an Illinois home rule municipality, have adopted local amendments to the 2018 International Building Code published by the International Code Council for the control of buildings and structures as provided therein; and
WHEREAS, amendments to the International Building Code are published from time to time, and the Village reviews and adopts such updated Code provisions to keep the Village Code up to date and in line with widely accepted and adopted international standards; and
WHEREAS, the Village further has engaged in a process to solicit input and keep the building community informed about the potential changes; and
WHEREAS, the local changes adopted relate, in part, to the adoption of updated requirements regarding elevator inspections, which require an adjustment to the Village’s fee structure; and
WHEREAS, the President and Board of Trustees have considered these proposed adjustments; have offered input; and have determined them to be in the best interests of the Village and its residents;
NOW, THEREFORE, Be It Ordained by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:
SECTION 1
This Board finds and determines that the adoption of the following amendments to Title 5, Chapter 2 of the Village Code of the Village of Orland Park is in the best interests of the Village and its residents, and is in the public interest.
SECTION 2
Title 5, Chapter 2, Section 5-2-7-10 of the Village Code of the Village of Orland Park is hereby amended by adopting the following changes by deleting the text marked with strikethrough and adding the text marked in underline.
“5-2-7-10 Miscellaneous Fees:
. . .
c. Elevators, Escalators and Dumbwaiters Fees:
1. A review of Shop Drawing plans and specifications for each new elevator, escalator, dumbwaiter or similar device shall be One Hundred and Fifty Dollars ($150.00) per device.
2. a. Review of Architectural Drawings when required shall be One Hundred and Fifty Dollars ($150.00).
2. 3. The inspection of each new device shall be One Hundred and Ten Dollars ($110.00).. 3 Semi-annual and/or any The reinspection of an existing device shall be Fifty-five Dollars ($55.00).
4. Required pressure test witnessing fees by a qualified elevator inspector shall be not less than the contracted inspection agreement with the Village.
SECTION 3
To the extent necessary, all tables of contents, indexes, headings, and internal references or cross-references to Sections that need to be amended or deleted within the Orland Park Village Code, as amended, as a consequence of the above Code Amendments, shall be amended by the Village’s codifier so as to be consistent with the terms of this Ordinance.
SECTION 4
All ordinances, or parts of ordinances, in conflict with the provisions of this Ordinance, to the extent of such conflict, are repealed.
SECTION 5
Each section, paragraph, clause and provision of this Ordinance is separable and if any provision is held unconstitutional or invalid for any reason, such decision shall not affect the remainder of this Ordinance, nor any part thereof, other than that part affected by such decision.
SECTION 6
Except as to the Code amendments set forth above in this Ordinance, all Chapters and Sections of the Orland Park Village Code, as amended, shall remain in full force and effect.
SECTION 7
This Ordinance shall be in full force and effect from and after its adoption and publication in pamphlet form as provided by law.
SECTION 8
The Village Clerk be and herby is authorized and directed to publish this Ordinance in pamphlet form.
