AN ORDINANCE AUTHORIZING CONVEYANCE OF PROPERTY (SWALLOW RIDGE)

Body

WHEREAS, the President and Board of Trustees of the Village of Orland Park have approved the conveyance of a parcel of land in the Swallow Ridge Subdivision, located at 17400 S. 104th Avenue in the Village.  Said parcel is legally described as follows:

 

THE EAST 110 FEET OF LOT 21 IN THE SWALLOW RIDGE SUBDIVISION, A SUBDIVISION IN THE SOUTHEAST ¼ (EXCEPT THE NORTH ½ OF THE NORTH ½   THEREOF) AND (EXCEPT THE SOUTH 25 ACRES THEREOF) OF SECTION 29, TOWNSHIP 36 NORTH, RANGE 12, EAST OF THE THIRD PRINCIPAL MERIDIAN IN COOK COUNTY, ILLINOIS (THE “SUBJECT PROPERTY”); and

 

WHEREAS, pursuant to the Annexation Agreement between the Village and the owner Beverly Ridge Realty Corp., the entire Lot 21 was conveyed to the Village to meet compensatory storm water storage requirements, and the Federal Emergency Management Agency (“FEMA”) has designated the Subject Property as located in a floodway/floodplain, which designation renders the Subject Property unbuildable under Village Codes and Ordinances; and

 

WHEREAS, it appears that the Subject Property is, in fact, not properly designated as located in a floodway/floodplain and is not needed for compensatory storm water storage to serve the Swallow Ridge Subdivision; and

 

WHEREAS, the aforesaid Annexation Agreement provided that in the event it was subsequently determined that the Subject Property was removed from the floodway/floodplain designation on the FEMA Flood Insurance Rate Map (“FIRM”), the Subject Property could then be developed and sold by the owner/subdivider as a buildable lot. 

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

The Village shall convey the Subject Property to Beverly Ridge Realty Corp., and the Village President and Village Clerk are hereby authorized and directed to execute the necessary conveyance deed, provided that neither Beverly Ridge Realty Corp. nor any successor in title, shall develop the Subject Property as a buildable lot and no building permit shall be issued for said Subject Property unless and until:

 

a)  Beverly Ridge Realty Corp. shall, at its expense, cause to be prepared and recorded an approved plat of resubdivision identifying the Subject Property as Lot 23 in the Swallow Ridge Subdivision, and

 

b)  The FEMA Map (FIRM) is amended or corrected to remove the Subject Property from the floodway/floodplain designation with all applications to FEMA describing the current condition and topography of the Subject Property.

 

SECTION 2

 

That this Ordinance shall be in full force and effect from and after its adoption and approval as provided by law.
