Village Code Amendment to the Qualifications of Part-time Police Officers - Recommended Ordinance

 

History

The Police Department recently received correspondence from the Illinois Law Enforcement Training and Standards Board (ILETSB) that described state statutes and administrative rules governing the hiring of part-time police officers.  A review of the current Village Code revealed some omissions that needed to be added to bring the Village Code into conformance with these standards.

 

Staff worked on these standards and a sample ordinance provided to develop a draft that will bring the current Village Code into conformance with these requirements.  The attached Village Code proposal represents that effort and upon its passing will conform to the directives of the ILETSB.

Recommended Action/Motion

I move to recommend to the Village Board to pass an Ordinance entitled: AN ORDINANCE AMENDING TITLE 8 OF THE ORLAND PARK VILLAGE CODE WITH REGARD TO THE QUALIFICATIONS OF PART-TIME POLICE OFFICERS

 

Body

WHEREAS, the Village President and Board of Trustees of the Village of Orland Park (the “Village”) have the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and to protect the public health, safety and welfare of its citizens; and

 

WHEREAS, pursuant to 65 ILCS 5/11-1-1 (2010), the President and Board of Trustees may pass and enforce all necessary police ordinances and Title 8, Chapter 1, Section 8-1-14 of the Village Code establishes the position of part-time police officer, the number of such officers as shall be determined by the corporate authorities of the Village with duties assigned to such part-time police officers as prescribed by the Chief of Police or his or her designee; and

 

WHEREAS, it is in the best interests of the health, safety and welfare of the citizens and residents of the Village that such part-time police officers possess proper qualifications in order to obtain and maintain employment as part-time police officers;

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

The above recitals are incorporated herein by reference as though fully set forth herein.

 

SECTION 2

 

That Title 8, Chapter 1, Section 8-1-3, paragraph 3, is amended so as to read in its entirety as follows:

 

“3.  Any person employed as a part-time police officer must meet the following standards and possess the following qualifications:

 

a.  Be twenty-two (22) years of age upon the date of application for employment;

 

b.  Be a citizen of the United States;

 

c.  Be of good moral character, temperate habits,  of sound health and physically and mentally able to perform the essential functions and assigned duties of the position as the law provides;

 

d.  Have been trained in accordance with the Illinois Police Training Act (50 ILCS 705/1, et seq.) and the rules and requirements of the Illinois Law Enforcement Training and Standards Board;

 

e.  Have completed a forty (40) hours mandatory firearms training course;

 

f.  Submit to, and pass, an extensive background investigation as established by the Chief of Police or his/her designee;

 

g.  Subsequent to a conditional job offer, submit to, and pass, a physical examination conducted by an Illinois licensed physician;

 

h.  Possess a high school diploma or GED certificate, 60 hours of college credit is preferred;

 

i.  Possess a valid State of Illinois driver’s license;

 

j.  Have no felony convictions; and

 

k.  If having served in the United States military, must have been honorably discharged.”

 

SECTION 3

 

That Title 8, Chapter 1, Section 8-1-3 is hereby further amended by adding the following paragraph 4:

 

“4.  A part-time police officer shall have all the responsibilities of a full-time police officer and such specific duties as delineated in the General Orders of the Orland Park Police Department and as prescribed by the Chief of Police or his/her designee, but the number of hours a part-time police officer may work within a calendar year is restricted as prescribed by the Chief of Police or his/her designee.  Part-time police officers shall not be assigned to supervise or direct full-time police officers.”

 

SECTION 4

 

All ordinances in conflict herewith are hereby repealed to the extent of such conflict.

 

SECTION 5

 

This ordinance shall be in full force and effect from and after its adoption, approval and publication in pamphlet form as provided by law.
