Title: Orland Park Business Center - Overpayment of Water Tap Fees

Title

Orland Park Business Center  -  Overpayment of Water Tap Fees

History

The Orland Park Business Center (OPBC) annexation agreement was approved in 2001.  One of the conditions of the annexation agreement was water tap fees would not increase during the term of the agreement. Since 2001, water tap fees (Village-wide) have increased periodically.

Recently, the Village was notified by John Charles Midwest, Inc. that certain building permits in the OPBC were charged current water tap fees instead of the fees set by agreement.  They have requested reimbursement of these fees, in the amount of $95,900 (see attached documentation) for a total of 15 individual projects.  The majority of these permits were paid and issued in 2004.  Prior to agreeing to the reimbursement amount, staff verified that no additional fees were owed to the Village for these specific building projects.  Based upon this review, the total amount due is $81,207.83.  Three separate checks will need to be issued:

John Charles Midwest, Inc.                                          $49,048.23

TCB Development                                                               $23,747.96

Technic Dental Lab, Inc.                                          $ 8,411.64

                                          Total                                                               $81,207.83

On April 28, 2008 the Development Services and Planning Committee moved 2-0 to recommend to the Village Board of Trustees reimbursement of OPBC water tap fees in the amount of $81,207.83, as outlined.

This is now before the Village Board for consideration.

Recommended Action/Motion
