AN ORDINANCE AUTHORIZING RELEASE (ABROGATION) OF DRIVEWAY EASEMENT (FORMER “BROWN DRIVE” LOCATED EAST OF AND ADJOINING FORMER I.N.R. BEATTY LUMBER CO. SITE)

Body

WHEREAS, by Warranty Deed dated April 17, 1956, recorded in Cook County, Illinois, on July 5, 1956, as document number 16629437, and by an Agreement of the same date by and between the same parties recorded in Cook County, Illinois, on July 5, 1956, as document number 16629438, by and between ZIMMERMAN CUT STONE CO. and McDANIEL IRON WORKS, INC., there was reserved and granted a driveway easement over, upon and across the property described in Exhibit “A” attached hereto; and

 

WHEREAS, the parties to said Warranty Deed and Agreement have ceased to exist, and the Village now owns the fee title to the property described in EXHIBIT “A”.

 

WHEREAS, the future owners of the said property have requested the Village to release or abrogate said easement, and it has been determined by the Village staff that the Village has no facilities located within said easement, and it is anticipated that the Village will have no future need for said easement;

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

A Release (Abrogation) of Easement in a form acceptable to the Village attorney is hereby approved, and the Village President and Village Clerk are hereby authorized and directed to execute said document on behalf of the Village.

 

SECTION 2

 

This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
