ORDINANCE APPROVING RELEASE (ABROGATION) OF WIRELINE EASEMENT AND APPROVING TERMINATION OF USE AND INDEMNIFICATION AGREEMENT (9750 ON THE PARK PROJECT)

 

Body

WHEREAS, the Village President and Board of Trustees of the Village of Orland Park previously authorized the execution of a Wireline Easement Agreement between the Village and the Commuter Rail Division of the Regional Transportation Authority (“Metra”) and, in conjunction therewith, authorized a Use and Indemnification Agreement between the Village and Metra Triangle FC, LLC, the developer of the 9750 On The Park Project; and

 

WHEREAS, it has been determined that said Wireline Easement Agreement is no longer necessary or useful to the Village and Metra and, further, that said Use and Indemnification Agreement is no longer necessary.

 

NOW, THEREFORE, BE IT ORDAINED by the Village President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

The Release (Abrogation) of Wireline Easement, in substantially the form attached hereto as Exhibit “A,” is approved, and the Village President and Village Clerk (or Deputy Village Clerk) are hereby authorized and directed to execute the same on behalf of the Village.

 

SECTION 2

 

The Termination of Use and Indemnification Agreement, in substantially the form attached hereto as Exhibit “B,” is hereby approved, and the Village Manager is hereby authorized and directed to execute the same on behalf of the Village.

 

SECTION 3

 

This Ordinance shall be effective immediately upon its passage and approval as provided by law.
