PROJECT:
Charleton Highlands Subdivision (formerly Sheffield Highlands), located at the southwest corner of 163rd Street and 94th Avenue, was approved by the Village Board on July 6, 2005 as a Planned Development with 23 detached single-family units. The subdivision is currently under construction, with two units in the ground.

On October 23, 2007, the petitioner requested variances to reduce the rear yard setbacks for lots 17, 18, and 19, and appeared before Plan Commission with this proposal. When Plan Commission expressed concerns with that proposal, the petitioner suggested this alternative that is before you tonight. Both petitions are before the Plan Commission for consideration at this time.

PETITIONER:
David B. Sosin, representing Charleton Highlands Development, LLC

REQUESTED ACTION:
The petitioner has submitted a request to re-subdivide Charleton Highlands Planned Development. The changes focus on lots 17, 18, and 19. At the November 27, 2007 Plan Commission, the petitioner had requested approval of a variance to reduce rear yard setback requirements on lots 17, 18, and 19. The public hearing for the variance was continued to December 11, 2007.

On December 11, 2007 the Plan Commission moved 7-0 to recommend to the Village Board approval of the requested Resubdivision for Charleton Highlands Subdivision, as illustrated on the “Charleton Highlands Re-Subdivision II, Survey No. 03-08-043-RESUB" by KDC Consultants Inc. and dated October 24, 2007 and revised November 8, 2007 with the following condition:
1. That the petitioner meet the required setback dimensions, required on the previously-approved variance.

And
Moved to terminate the original variance request.
