AN ORDINANCE AMENDING TITLE 9, CHAPTER 7, OF THE ORLAND PARK VILLAGE CODE IN REGARD TO TRUCK PARKING

WHEREAS, the Village President and Board of Trustees of the Village of Orland Park (the “Village”) have the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and protect the public health, safety, and welfare of its citizens; and
WHEREAS, pursuant to 65 ILCS 5/1-2-1, the Village may pass all ordinances and make all rules and regulations proper or necessary, to carry into effect the powers granted to municipalities, with such fines or penalties as may deemed proper; and
WHEREAS, the Village, as a home rule municipality, has the authority under Article VII, Section 6 of the Illinois Constitution of 1970 to impose fines and penalties in excess of $750; and
WHEREAS, the Village has determined that the amendment set out below is in the best interests of the Village and its residents and will enhance the public safety and welfare.
NOW, THEREFORE, Be It Ordained by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:
SECTION 1
Title 9, Chapter 7, Section 9-7-9-2 of the Orland Park Village Code is hereby amended to add the following as the third (3rd) paragraph in said Section:
“9-7-9-2: TRUCK PARKING RESTRICTED:

No truck or other commercial vehicle which has a weight exceeding 8,000 pounds (calculated by adding the vehicle weight plus the weight of its maximum loan capacity) or which exceeds twenty-one (21) feet in length or exceeds eight (8) feet in width or exceeds nine (9) feet in height may be parked on any public street or alley. The overnight parking of such vehicles is not permitted in any residential front, rear or side set back (including a residential driveway) or in any commercial parking lot (unless properly parked at a loading dock) or on any vacant parcel within a commercial or res...
