AN ORDINANCE AMENDING THE LAND DEVELOPMENT CODE OF THE VILLAGE OF ORLAND PARK, AS AMENDED (SECTION 6-207, CONGREGATE ELDERLY HOUSING AS A SPECIAL USE IN THE BIZ DISTRICT)

Body
WHEREAS, the Corporate Authorities of the Village of Orland Park, an Illinois home rule municipality, have on February 8, 1991, adopted a Land Development Code (“the Code”) and zoning map; and

WHEREAS, amendments to the Code are adopted from time to time to insure that the Code is up to date and responsive to community needs; and

WHEREAS, an amendment has been proposed regarding designation of congregate elderly housing as a special use in the BIZ General Business District in the Code; and

WHEREAS, allowing congregate elderly housing in the BIZ General Business District is found to be desirable because residents of such housing often prefer to be in close proximity to commercial services such as restaurants and retail stores that are easily accessible by car or by foot, however, the special use designation is desirable because the variety and density of other uses permitted in the BIZ District makes it appropriate to scrutinize the placement and conditions of congregate elderly housing in the BIZ District by the special use procedure; and

WHEREAS, the Plan Commission of the Village held a public hearing on March 10, 2009 on whether the proposed amendment should be approved, at which time all persons present were afforded an opportunity to be heard; and

WHEREAS, a public notice in the form required by law was given of said March 10, 2009 public hearing date by publication not more than thirty (30) days nor less than fifteen (15) days prior to said date in the Orland Park Prairie, a newspaper of general circulation published in this Village; and

WHEREAS, the Plan Commission of this Village has filed its report of findings and recommendation that the attached proposed amendment to Section 6-207 of the Land Development Code of the Village be made, and this Board of Tr...
