AN ORDINANCE AMENDING TITLE 5 (BUILDING), CHAPTER 2 (BUILDING PERMITS AND FEES), SECTION 5-2-2 (APPLICATION FOR PERMITS) OF THE ORLAND PARK VILLAGE CODE REGARDING DEBT OWED TO THE VILLAGE OF ORLAND PARK

WHEREAS, the Village of Orland Park, (hereafter the "Village") is a home rule municipality and pursuant to the Illinois Constitution, Article VII, Section 6, has certain powers which it is exercising; and
WHEREAS, the Village may regulate the issuance of building permits within the Village of Orland Park pursuant to its home rule authority and pursuant to the Illinois Municipal Code; and
WHEREAS, in exercise of its home-rule authority, the Village, through its President and Board of Trustees, has found and determined that it is in the best interest of the Village and its residents that no building permit be issued without all outstanding debts, fees, fines, or other sums due to the Village be satisfied.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ORLAND PARK, COOK AND WILL COUNTIES, ILLINOIS AS FOLLOWS:
SECTION 1
That the findings contained in the preamble to this Ordinance are found to be true and correct and are hereby adopted as part of this ordinance.
SECTION 2
That Section 5-2-2 of the Orland Park Municipal Code is hereby modified by adding the following text to the second paragraph as follows (new text indicated by underlining):
“5-2-2: Application for Permits:

In those instances where the request for a building permit relates to a business, commercial or industrial use for all or part of the real estate described in the permit application, the building permit shall not be issued until the Development Services Department approves shall approve the site plan and utilities. Any individual or business seeking to obtain or renew a building permit must be in good standing with the Village by resolving all outstanding fees, fines, or other sums due to the Village.”
