AN ORDINANCE AMENDING THE ORLAND PARK VILLAGE CODE, TITLE 5, CHAPTER 4, THE ORLAND PARK PLUMBING CODE, REGARDING LAWN SPRINKLER SYSTEMS

Body
WHEREAS, the Village of Orland Park has, in Title 5, Chapter 4 of the Village Code adopted the 2004 Illinois State Plumbing Code, 77 Illinois Administrative Code, part 890 et seq., with certain modifications, as the Plumbing Code of the Village; and

WHEREAS, from time to time, the Village makes additional modifications to its adopted Plumbing Code when the Corporate Authorities find such modifications to be in the best interest of the Village and its residents; and

WHEREAS, the Corporate Authorities find that amending the Village Plumbing Code to require all lawn sprinkler systems to be equipped with an approved rain detection device is in the best interests of the Village and its residents because it will operate to conserve water, a natural resource in limited supply.

NOW, THEREFORE, Be It Ordained by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

SECTION 1

The above preambles are hereby incorporated into this section as fully as if restated herein in their entirety.

SECTION 2

Title 5, Building, Chapter 4, Plumbing Code, of the Village Code of Orland Park, Section 5-4-3, Modifications, is hereby amended to add the following sentence at the end of the first full sentence in item 4 of Section 5-4-3: “The Village shall not be responsible for the maintenance of private lawn sprinkler systems within the public rights-of-way. The adjacent property owner assumes all risk involved in choosing to place lawn sprinkler components in the public rights-of-way. Furthermore, the Village of Orland Park shall not be responsible for the restoration or repair of private sprinkler systems within the public rights-of-way.”
