AN ORDINANCE VACATING A CERTAIN SANITARY SEWER EASEMENT - HORTON SUBDIVISION

Body

WHEREAS, the Board of Trustees of the Village of Orland Park, after due investigation and consideration, has determined that the nature and extent of the public use or public interest to be subserved is such as to warrant the vacation of a certain easement situated within the subdivision known as Horton Subdivision, Lots 1 and 2, as hereinafter described; and

 

 

WHEREAS, the public utility easement is no longer needed for sanitary sewer purposes, and the vacation of such easement will not destroy any rights or privileges of any properties within said Horton Subdivision or otherwise.

 

 

NOW, THEREFORE, Be It Ordained by the President and Board of Trustees of the Village of Orland park, Cook and Will Counties, Illinois, as follows:

 

 

SECTION 1

 

That the easement for sanitary sewer purposes legally described on the Plat of Vacation, which is attached hereto and hereby made a part hereof, in the aforesaid Horton Subdivision be and the same is hereby vacated.  The public interest will be served by such vacation.

 

 

SECTION 2

 

The Village Clerk is hereby directed to file for record in the appropriate office of the Will County Recorder of Deeds, a certified copy of this ordinance and said Plat of Vacation in the manner and as may be required by law.

 

 

SECTION 3

 

All ordinances or parts of ordinances in conflict herewith are hereby repealed.

 

 

 

SECTION 4

 

This Ordinance shall be in full force and effect from and after its passage by an affirmative vote of a least three-fourths (3/4) of the Trustees now holding office and approved in the manner provided by law.
