ORDINANCE AUTHORIZING RELEASE (ABROGATION) OF PART OF THE CONSERVATION EASEMENT (14525 SOUTH BEACON AVENUE)

Body

WHEREAS, by a Plat of Vacation and Grant of Conservation Easement, there was reserved and granted to the Village a conservation easement over, upon and across the following described property, to wit:

 

A PORTION OF 145TH PLACE LYING EAST OF THE WEST LINE OF LOT 29 IN GEE’S 2ND ADDITION TO ORLAND PARK, BEING A SUBDIVISION OF THAT PART OF THE NORTH 30 ACRES OF THE SOUTH 60 ACRES LYING SOUTH OF THE NORTH 455 FEET THEREOF, OF THE WEST ½ OF THE NORTHEAST ¼ OF SECTION 9, TOWNSHIP 36 NORTH, RANGE 12 EAST OF THE THIRD PRINCIPAL MERIDIAN, EXCEPT THE NORTHWEST CORNER THEREOF TAKEN FOR WABASH R.R. RIGHT OF WAY, EXTENDED SOUTH TO THE SOUTH RIGHT OF WAY LINE OF SAID 145TH PLACE AND LYING WEST OF THE EAST LINE OF SAID LOT 29 EXTENDED SOUTH TO THE SOUTH RIGHT OF WAY LINE OF SAID 145TH PLACE, IN COOK COUNTY, ILLINOIS; and

 

WHEREAS, the owner of the north half of the conservation easement area has requested the Village to release or abrogate two feet of said easement, and it has been determined by the Village staff that the Village has no facilities located within said easement, and it is anticipated that the Village will have no future need for said easement;

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

The Release (Abrogation) of Easement in the form of the Plat of Abrogation attached hereto as Exhibit 1 is hereby approved, and the Village President and Village Clerk are hereby authorized and directed to execute said document on behalf of the Village.

 

SECTION 2

 

This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
