History
This is a request for approval of a landscape plan for the Shops at 88th, a commercial development at the southeast corner of 159th Street and 88th Avenue. The Village Board approved the site plan and elevations for the Shops of 88th in April of 2006 with the following landscape related conditions:

The petitioner submit a landscape plan per Village Code, within 60 days of final engineering approval for separate review and Village Board approval.

That the final landscape plan substitute 50% of the required Deciduous Bufferyard Trees with Evergreen trees along the South Bufferyard in order to create a more solid screen from the adjacent residences.

Per Code requirements, the petitioner submitted a landscape plan that has been reviewed and approved by the Village’s Landscape Architect consulting firm. A copy of the approval memo is attached for review. The Village and the petitioner worked with the adjacent homeowners association throughout the review and approval process in order to design an effective buffer between the commercial center and the existing townhomes and condominiums.

The consultants recommended two conditions that are not included in the approval motion below. First, the consultant recommends to set the bond at a minimum of 110 percent of the indicated total cost in the landscape estimate. Current Village Code actually requires a 25% contingency on all letter of credit estimates. Second, the consultant recommends protecting the detention area with a conservation easement. However, the Village typically uses conservation easements to protect existing vegetation, not newly design detention ponds, therefore, it is not included in the motion. The maintenance and establishment of the pond is the responsibility of the property owner and will be enforced via the Board approved landscape plan.
