AN ORDINANCE AMENDING TITLE 2, CHAPTER 16, SECTION 2-16-1 OF THE ORLAND PARK VILLAGE CODE DESIGNATING AN AUDITING OFFICIAL FOR THE VILLAGE OF ORLAND PARK

WHEREAS, the SAFE-T Act (Public Act 101-0652) was enacted on February 22, 2021; and
WHEREAS, the SAFE-T Act amends the Public Officer Prohibited Activities Act by requiring every unit of local government to appoint an “auditing official” whose duties include but are not limited to receiving, registering, and investigating complaints and information concerning
misconduct, inefficiency, and waste within the unit of local government; investigating the performance of officers, employees, functions, and programs; and promoting economy, efficiency, effectiveness and integrity in the administration of the programs and operations of the municipality; and
WHEREAS, in the absence of the designation of such an official, those duties fall to the State’s Attorney of the county where the unit of local government is appointed; and
WHEREAS, the President and the Board of Trustees of the Village of Orland Park find it to be in the best interests of the Village to designate an Auditing Official; and
WHEREAS, the President and the Board of Trustees of the Village of Orland Park desire to designate the Village’s Ethics Officer as the Auditing Official.
NOW, THEREFORE, BE IT RESOLVED, by the Village President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:
SECTION 1
The above recitals are incorporated by reference into this Section 1 and made a part hereof as though fully set forth herein.
SECTION 2
Title 2, Chapter 16, Section 2-16-1 of the Orland Park Village Code is amended by adding the following language: “The designated Ethics Officer shall also serve as the designated Auditing Official of the Village of Orland Park for the purposes set forth in the Public Officers Prohibited Activities Act, Section 4.1 (50 ILCS 105/4.1).
