ORDINANCE AUTHORIZING RELEASE (ABROGATION) OF                      PUBLIC UTILITY EASEMENT (ORLAND PARK CROSSING FIRST RESUBDIVISION)

Body

WHEREAS, by Plat of Subdivision for the original Orland Park Crossing, there was reserved and granted to the Village a public utility easement over, upon and across a portion of Lots 9 and 12 (“Easement Area”) in said subdivision, as recorded per Document Number 0525845136; and

 

WHEREAS, the property owner of said Easement Area has re-established said public utility easement via creation and recording of the Final Plat of Orland Crossing First Resubdivision, Document Number 1513544065 on May 15, 2015, as a result of recognizing the commercial building encroaches upon said Easement Area, and which re-established easement has again been dedicated to the Village and the respective utility companies for the purpose of public utilities; and

 

WHEREAS, the owner of said Easement Area has requested the Village to release or abrogate said easement, and relocation of an existing sanitary sewer main has been authorized by the Village staff, and therefore the Village will have no future need for a portion of said Easement Area;

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

 

The Plat of Easement Abrogation in the form attached hereto as Exhibit 1 is hereby approved, and the Village President and Village Clerk are hereby authorized and directed to execute said document on behalf of the Village.

 

SECTION 2

 

This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
