Title

AN ORDINANCE ESTABLISHING THE OFFENSE OF MISREPRESENTATION OF AGE

 

Body

WHEREAS, the Corporate Authorities of the Village of Orland Park, Cook and Will Counties, Illinois, deem it in the best interests of the Village and its residents to enact a local ordinance regarding misrepresentation of age.

 

NOW, THEREFORE, Be It Ordained by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, an Illinois Home Rule Municipality, as follows:

 

SECTION 1

 

Title 8, Police, Chapter 6 Offenses Section 1 offenses relating to the person is hereby amended to add subsection 8-6-1-6, Misrepresentation of Age, to read as follows:

 

8-6-1-6                        Misrepresentation of Age

 

A person who falsely states either orally or in writing that he or she is of an age that he or she is not, or who presents or offers to any person any evidence of age or identity that is false or not actually his or her own, for the purpose of obtaining, viewing or otherwise procuring or attempting to procure or view any age-restricted material or participating in any age-restricted activity, is guilty of violating this Section.

 

A person who is convicted of violating this Section shall be fined not less than one hundred dollars ($100) and not more than seven hundred fifty dollars ($750).  In addition to a fine, any person convicted of violating this Section may be required by the court or administrative hearing officer to perform public/community service work.

 

SECTION 2

 

If any section, subsection, clause or phrase of this Ordinance is for any reason held to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this Ordinance.

 

 

SECTION 3

 

All ordinances or parts of ordinances in conflict herewith are to the extent of such conflict, hereby repealed.

 

 

 

SECTION 4

 

This Ordinance shall be in full force and effect from and after its passage, approval and publication as required by law.
