ORDINANCE AUTHORIZING RELEASE (ABROGATION) OF PUBLIC UTILITY EASEMENT (LOT 1 IN ORLAND PARK PRAYER CENTER)

Body

WHEREAS, by Plat of Subdivision for Orland Park Prayer Center, there was reserved and granted to the Village a public utility easement over, upon and across a portion of Lot 1 in said subdivision, as recorded per Document Number 0811916073; and

 

WHEREAS, the owner of said Lot 1 is relocating said public utility easement, which relocated easement will be dedicated to the Village; and

 

WHEREAS, the owner of said Lot 1 has requested the Village to release or abrogate said easement as it affects Lot 1, and it has been determined by the Village staff that the Village has no facilities located within said easement, and it is anticipated that the Village will have no future need for said easement;

 

NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

SECTION 1

The Release (Abrogation) of Easement in the form attached hereto as Exhibit 1 is hereby approved, and the Village President and Village Clerk are hereby authorized and directed to execute said document on behalf of the Village.

 

SECTION 2

The Easement Grant for a public utility easement under, across and through a portion of Lot 1 of Orland Park Prayer Center Subdivision in the form attached hereto as Exhibit 2 is hereby approved, and the Village President and Village Clerk are hereby authorized and directed to execute said document on behalf of the Village.

 

SECTION 3

This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
