A RESOLUTION APPROVING AN APPEAL FROM THE PROVISIONS OF THE ORLAND PARK BUILDING CODE REGARDING FIREPLACE VENTING (CRYSTAL TREE)

Body
WHEREAS, the Village of Orland Park has adopted the 2006 Edition of the International Building Code with specific amendments as the Orland Park Building Code; and

WHEREAS, the Orland Park Building Code Section 2802 (found at item 184 of the amendments to the IBC) provides that no unvented fireplaces may be installed in any building without the approval of the code official; and

WHEREAS, the Orland Park Code official has reviewed a request to install two unvented fireplace units in the Crystal Tree Country Club, a certain building under development at this time in the Village; and

WHEREAS, the Code Official’s review addressed the available ventilation in the room(s) in which the fireplaces would be installed, and determined that adequate ventilation will be available for public safety; and

WHEREAS, because the ventilation will be adequate, the code official has recommended that the corporate authorities approve the request for a variance from the Orland Park Building Code and the Building Committee of the Village Board has reviewed the request as well and has recommended permitting such use.

NOW, THEREFORE, Be It Resolved by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

SECTION 1

The above provisions are hereby incorporated into this Resolution as fully as if restated in this Section in their entirety.

SECTION 2

Pursuant to the calculations of the Code Official of the Village, the volume of air available in the room(s) the fireplaces are proposed to be installed far exceeds the minimum required by the National Fuel Gas Code. (The National Fuel Gas Code would require 2,000 cubic feet of air space per unvented unit; the two units requested have a total of 26,000 cubic feet of air available.)
