ORDINANCE AUTHORIZING RELEASE (ABROGATION) OF PUBLIC UTILITY AND DRAINAGE EASEMENT (LOT 19 SILO RIDGE ESTATES UNIT 4)
Body
WHEREAS, by Plat of Subdivision for Silo Ridge Estates Unit 4, there was reserved and granted to the Village and utility companies a drainage and public utility easement over, upon and across a portion of the 40 foot rear yard of Lot 19 in said subdivision; and
WHEREAS, the owner(s) of said Lot 19 is locating an in-ground swimming pool which will extend or encroach approximately 5 feet onto or upon said easement; and
WHEREAS, the owner(s) of said Lot 19 has requested the Village to release or abrogate said easement as it affects Lot 19, and it has been determined by the Village staff that the Village has no facilities located within said easement, and it is anticipated that the Village will have no future need for said easement;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:
SECTION 1
The Release (Abrogation) of Easement in the form attached hereto as Exhibit 1 is hereby approved, and the Village President and Village Clerk are hereby authorized and directed to execute said document on behalf of the Village.
SECTION 2
This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
