ORDINANCE APPROVING WIRELINE EASEMENT AGREEMENT BETWEEN VILLAGE AND COMMUTER RAIL DIVISION OF THE REGIONAL TRANSPORTATION AUTHORITY (METRA - 143rd STREET)

WHEREAS, the Commuter Rail Division of the Regional Transportation Authority (“Metra”) has granted to the Village a permanent easement for wireline purposes over, upon and across a portion of Metra property; and
WHEREAS, the Corporate Authorities of the Village of Orland Park, Cook and Will Counties, Illinois, have determined that it is in the best interest of said Village of Orland Park that said Agreement be entered into by the Village of Orland Park;
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:
SECTION 1
The President and Board of Trustees of the Village of Orland Park hereby find that it is in the best interests of the Village of Orland Park and its residents that the “Wireless Easement Agreement between the Village and the Commuter Rail Division of the Regional Transportation Authority (METRA)” be entered into and executed by said Village of Orland Park with the Agreement to be in substantially the same form as attached hereto and made a part hereof as Exhibit 1.
SECTION 2
The Village President and Village Clerk are hereby authorized and directed to execute said Agreement on behalf of the Village.
SECTION 3
This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
