ORDINANCE AUTHORIZING RELEASE (ABROGATION) OF PART OF THE PUBLIC UTILITY AND DRAINAGE EASEMENTS OF STERLING RIDGE SUBDIVISION LOTS 19 AND 20

Body
WHEREAS, by a Plat of Subdivision, document number 0514744060, there was reserved and granted to the Village a public utility and drainage easement over, upon and across the following described property, to wit:

LOTS 19 AND 20 OF STERLING RIDGE, A SUBDIVISION IN THE SOUTH ½ OF THE NORTHWEST ¼ OR SECTION 29, TOWNSHIP 36 NORTH, RANGE 12 EAST OF THE THIRD PRINCIPAL MERIDIAN IN COOK COUNTY, ILLINOIS; and

WHEREAS, the owner of the subject property wishes to consolidate two lots into one, owner has requested the Village to release or abrogate the 7-1/2 foot wide easement along the east line of lot 19, excepting the north 10 feet of said easement, and the 7-1/2 foot wide easement along the west line of lot 20, excepting the north ten feet of said easement, and it has been determined by the Village staff that the Village has no facilities located within said easements, and it is anticipated that the Village will have no future need for said easements;

WHEREAS, the owner has obtained the necessary approvals of the utility companies to whom easement rights are reserved and granted, waiving said rights to the aforementioned certain easements,

WHEREAS, the Board of Trustees of the Village of Orland Park, after due investigation and consideration, has determined that the nature and extent of the public use or public interested to be subserved is such as to warrant the vacation of certain utility and drainage easements situated within the subdivision known as Sterling Ridge, between Lots 19 and 20,

WHEREAS, the public utility and drainage easements are no longer needed for utility and drainage purposes, and the vacation of such easements will not destroy any rights or privileges of any properties within Sterling Ridge Subdivision or otherwise.
