AN ORDINANCE VACATING CERTAIN UTILITY AND DRAINAGE EASEMENTS - DEER HAVEN ESTATES LOT 12

 

Body

WHEREAS, the Board of Trustees of the Village of Orland Park, after due investigation and consideration, has determined that the nature and extent of the public use or public interest to be subserved is such as to warrant the vacation of a certain utility and drainage easement situated within the subdivision known as Deer Haven Estates of:

 

PART OF THE NORTHWEST QUARTER OF SECTION 8, TOWNSHIP 36 NORTH, RANGE 12 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS, according to the plat thereof recorded October 2, 2007 as document number 0727515163.  Lot 12 P.I.N. = 27-08-109-015-0000

 

WHEREAS, a portion of the public utility and drainage easement is no longer needed for utility and drainage purposes, and the vacation of such easements will not destroy any rights or privileges of any properties within said Deer Haven Estates Subdivision or otherwise.

 

NOW, THEREFORE, be it ordained by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

 

 

SECTION 1

 

That the easements for utility and drainage purposes legally described and shaded on the Plat of Vacation, which is attached hereto and hereby made a part hereof, in the aforesaid Deer Haven Estates Subdivision be and the same are hereby vacated.  The public interest will be served by such vacation.

 

 

SECTION 2

 

The Village Clerk is hereby directed to file for record in the appropriate office of the Cook County Recorder of Deeds, a certified copy of this Ordinance and said Plat of Vacation in the manner and as may be required by law.

 

 

SECTION 3

 

All ordinances or parts of ordinances in conflict herewith are hereby repealed.

 

 

 

SECTION 4

 

This Ordinance shall be in full force and effect from and after its passage by an affirmative vote of at least three-fourths (3/4) of the Trustees now holding office and approved in the manner provided by law.
