AN ORDINANCE VACATING CERTAIN UTILITY AND DRAINAGE EASEMENTS - COYLE’S SUBDIVISION AND RESUBDIVISION

WHEREAS, the Board of Trustees of the Village of Orland Park, after due investigation and consideration, has determined that the nature and extent of the public use or public interest to be subserved is such as to warrant the vacation of certain utility and drainage easements situated within the subdivision known as Coyle’s Subdivision, between Lots 1 and 2 and between Lots 2 and 3 of:

COYLE’S SUBDIVISION OF PART OF THE WEST HALF OF THE SOUTHEAST QUARTER OF SECTION 5, TOWNSHIP 36 NORTH, RANGE 12 EAST OF THE THIRD PRINCIPAL MERIDIAN, IN COOK COUNTY, ILLINOIS,

recorded May 4, 2004, as document number 0412731054 and lying within Lots 7 and 8 of:
COYLE’S RESUBDIVISION OF LOTS 1, 2 AND 3 IN COYLE’S SUBDIVISION aforesaid.

WHEREAS, the public utility and drainage easements are no longer needed for utility and drainage purposes, and the vacation of such easements will not destroy any rights or privileges of any properties within said Coyle’s Subdivision or otherwise.

NOW, THEREFORE, Be It Ordained by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, as follows:

SECTION 1

That the easements for utility and drainage purposes legally described on the Plat of Vacation, which is attached hereto and hereby made a part hereof, in the aforesaid Coyle’s Subdivision be and the same are hereby vacated. The public interest will be served by such vacation.

SECTION 2

The Village Clerk is hereby directed to file for record in the appropriate office of the Cook County Recorder of Deeds, a certified copy of this Ordinance and said Plat of Vacation in the manner and as may be required by law.

SECTION 3

All ordinances or parts of ordinances in conflict herewith are hereby repealed.
