Title/Name/Summary

Osco Drug and Retail Center - Expiring Agreement

History

Osco (now CVS Pharmacy) located at Southwest Corner 143rd St. & Wolf Rd.

Background.  When Osco was approved, one of the conditions of approval was to bury the overhead utility lines.  Their development agreement is ready to expire and this condition has not been fulfilled.  Given the very high cost that ComEd charges (hundreds of thousands of dollars for this length of frontage) and the fact that burying lines generally has not been done in this area, it is recommended that this condition be waived in the development agreement.

Also, the ownership has changed from Osco to CVS.

Attached is a letter from Ken Friker, Village Attorney, recommending waiving this requirement.

Recommended Action/Motion

I move to waive the condition requiring burying of utility lines for the property at the southwest corner of 143rd St. & Wolf Road.

And

I move to approve allowing the Development Agreement for Osco Drug and Retail Center to expire.
