AN ORDINANCE AMENDING TITLE 7, CHAPTER 4 OF THE ORLAND PARK VILLAGE CODE WITH REGARDS TO RETAIL LIQUOR ESTABLISHMENTS

WHEREAS, the Village President and Board of Trustees of the Village of Orland Park (the “Village”) have the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and protect the public health, safety, and welfare of its citizens; and
WHEREAS, pursuant to 65 ILCS 5/1-2-1, the Village may pass all ordinances and make all rules and regulations proper or necessary, to carry into effect the powers granted to municipalities; and
WHEREAS, the Village deems it to be in the best interest of the public to update procedures for the issuance of Liquor Licenses in the Village to protect and promote the health, safety and welfare of the community.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, and pursuant to its home rule powers, as follows:
SECTION 1
The above recitals are incorporated herein by reference as though fully set forth herein.
SECTION 2
Title 7, Chapter 4, Section 7-4-6 is amended by deleting the language “There shall be a fee of two hundred seventy five dollars ($275) for this Temporary Class G-10 License.” Subparagraph
7.10 “Class G-10 License; Temporary Village Property License--Public” shall now read as follows (deletion marked by strikethrough):
“7.10 Class G-10 License; Temporary Village Property License--Public: A Class G-10 Temporary Village Property license may also be issued to entitle the licensee to conduct an event of no more than five (5) consecutive days open to the public on Village property at which event alcoholic liquor will be sold or served and consumed on the designated premises. Eligible locations shall be determined by the local liquor commissioner on a case by case basis with consideration given to the size, nature, date, security, and other particulars of the event. Any proposed event must also obtain a Special Event Permit pursuant to Title 3, Chapter 9 of the Village Code. No more than one (1) Temporary Class G-10 license shall be issued in the Village within a 7-day period. There shall be a fee of two hundred seventy five dollars ($275) for this Temporary Class G-10 license. Both the host of the event and any caterer or vendor employed for the event who will be serving alcoholic beverages must obtain licenses under this section,
either jointly or individually.
A Class G-10 Temporary Village Property licensee shall provide or cause to be provided comprehensive general liability insurance coverage in an amount of not less than two million dollars ($2,000,000.00) per occurrence and Liquor liability insurance in accordance with the Dram Shop Act of the State of Illinois with minimum limits of two million dollars ($2,000,000.00) so as to save and hold harmless the Village from financial loss, damage or harm arising from the activities pursuant to a Class G-10 Temporary Village Property license. The licensee must also execute an indemnification and hold harmless agreement of a form acceptable to the Village.”
SECTION 3
All Ordinances or parts of ordinances in conflict herewith are, to the extent of such conflict, hereby repealed.
SECTION 4
If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid, such decision or decisions shall not affect the validity of the remaining portions of this Ordinance.
SECTION 5
This Ordinance shall be in full force and effect from and after its adoption and publication in pamphlet form as provided by law.
SECTION 6
The Village Clerk be and hereby is authorized and directed to publish this Ordinance in pamphlet form.
