PROJECT DESCRIPTION & CONTEXT

The petitioner expanded the outdoor seating area via Appearance Review in 2018 (Legistar Number 2018-0297). Between the time of that approval and 2023, it was observed that an unapproved non code compliant fence was installed without a permit. A citation was written and issued to the petitioner (CE-24-00686). This petition seeks to document the history of the site and to ensure that the fencing around the outdoor seating area comes into compliance with Section 6-302 Accessory Structures. All licensing for the restaurant will be on hold until the site is in good standing. Currently, Girl in the Park holds active Business and Liquor Licensing.

DETAILED PLANNING DISCUSSION

Fencing

The service of liquor will require conformance with the provisions outlined in Section 6-310 Fences, as well as the requirements of the Village Code, as amended.  The Land Development Code states that fencing required with liquor sales: “at least 50% of the boundaries of any outdoor seating area on private property that will serve liquor be delineated, but not required to be fully enclosed, by a fence, wall, landscaping or similar barrier not less than twenty-four (24) inches in height and not greater than forty-eight (48) inches in height.”

The seating area currently does not comply with code. The existing fence is a wooden privacy fence which is 6 feet tall. The petitioner has indicated in writing and through a submitted Building Permit (BP-24-08916) that the fence will be cut down to 4 feet tall, and the fence will be flipped to have the finished side facing out.

With these proposed changes to the fence, the outdoor seating area will be in compliance with code.
