PROJECT DESCRIPTION & CONTEXT
The purpose of this petition is to remove arborvitae and trees along 14200 Brighton Court and replace with a 6’ privacy fence located 5’ off the property line of 143rd Street.
The recommendation motion includes the following conditions:
1) Install fence and footings entirely within petitioner’s property and outside of any required setback.
2) A payment to the Village of Orland Park in the amount of $750 ($250 per tree) for mitigation of the Oak being removed is paid prior to installation of fence.
3) Install finished side of fence towards street and neighboring properties.
4) Meet all final engineering and building code related items.
Overall, the project conforms to the Village’s Comprehensive Plan, Land Development Codes and policies for this area.
SITE PLAN
On the site plan, titled ‘Brighton Court Subdivision’, the proposed fence has been hand drawn in and highlighted. The proposed fence is a 6’ tall khaki colored privacy fence and spans from about 10’ from the west property boundary and 18’ from the east property boundary. The proposed fence has one 4’ wide gate proposed as shown on the attached Exhibit A. The fence will create a partial barrier between the petitioner’s parcel and 143rd Street for privacy purposes. The existing arborvitae in the location of the fence will be removed along with 3 trees. The applicant has proposed to plant 2 new lilac trees as mitigation, while the public works department will plant 3 Oak Trees in a nearby park, paid for by the applicant, as remaining tree mitigation for the project due to the reduced space for planting trees.
The new fence and landscaping are the only appearance changes that have been proposed for the site.
DETAILED PLANNING DISCUSSION
6-104.F Obstruction of Public Right of Way of the Land Development Code (LDC) states that except as otherwise permitted by these regulations, no structure, fence, landscaping, driveway, parking lot, newspaper vending machine or mailbox shall be permitted which obstructs or otherwise interferes with public use of a street right-of-way or other public easement.
Section 6-310.E.5 states that perimeter fences may be erected in the side and rear setback behind the front building line. These fences shall not exceed a height of six (6) feet and must be constructed entirely within the property where the permit is issued. The LDC also states that chain-link fences shall not be erected within five (5) feet of property lot lines within the Village, except for residential properties (chain-link was the original proposed material for this fence).
Section 6-310.C.5 states that no fence shall be constructed in such a manner as to impede or alter the natural surface water drainage of the property upon which the fence is constructed or any adjoining property. As the topography along the property lines where the fence is proposed is uneven, care should be taken to ensure the proposed fence does not alter existing water drainage.
Section 6-104.E states that clear sight triangles at street intersections are required for land abutting street intersections. The triangle bounded on 2 sides by the curb or pavement edge where measured in each direction along the curb or pavement edge from their point of intersection or pavement edge, and on the third side by the diagonal line connecting the ends of the sides.
The proposed specifications comply with the requirements listed in the Land Development Code.
Land Use and Compatibility
There are no changes to the land use for the site.
Lot Coverage
Lot coverage will not change as part of this project.
