Title

AN ORDINANCE OF THE VILLAGE OF ORLAND PARK, COOK AND WILL COUNTIES, ILLINOIS APPROVING THE DISCONTINUATION OF THE MAIN STREET TAX INCREMENT FINANCING DISTRICT

 

Body

 

                     WHEREAS, the Village of Orland Park (“Village”) is a home rule unit of local government pursuant to Section 6 of Article VII of the Constitution of the State of Illinois, and has the authority to exercise any power and perform any function pertaining to its government and affairs; and

 

 

WHEREAS, subject to that Section 6, a home rule unit may exercise any power and perform and function pertaining to its government and affairs for the protection of the public health, safety, morals and welfare; and

 

 

WHEREAS, the President and Board of Trustees, by Ordinance # 3943 established The Main Street Orland Park Tax Increment Financing District (“MST TIF”) on October 4, 2004, and amended the MST TIF pursuant to Ordinance No. 4297 on October 15, 2007 and again on October 7, 2024 pursuant to an ordinance currently styled as Ordinance No. 0665; and

 

 

                     WHEREAS, the Village President and Board of Trustees desire to now discontinue the MST TIF pursuant to the Tax Increment Allocation Redevelopment Act, 65 ILCS 5/11-74.4-1, et seq. (“TIF Act”) and Section 6 of Article VII of the Illinois Constitution; and

 

 

                     WHEREAS, on October 6, 2025, the Village Board approved the execution of an Agreement with Orland School District 135 and Consolidated High School District 230 to, among other things, discontinue the Main Street TIF District no later than December 31, 2025; and

 

 

                     WHEREAS, A Joint Review Board meeting was held on October 16, 2025, where the proposed discontinuation of the MST TIF District was discussed; and

 

 

                     WHEREAS, on October 16, 2025, the Joint Review Board recommended the discontinuation of the MST TIF Plan; and

 

 

                     WHEREAS, the Village President and Board of Trustees desire that the ordinances and laws governing the currently existing MST TIF be declared null and void and the MST TIF be dissolved; and

 

 

                     WHEREAS, the Village has complied with the specific notice requirements for the Joint Review Board meeting and public hearing requirements provided for in the TIF Act as a prerequisite to the actions contemplated by this Ordinance;

 

                     

NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF ORLAND PARK, COOK AND WILL COUNTIES, ILLINOIS, AS FOLLOWS:

 

 

SECTION 1

 

 

Incorporation. The recitals above shall be and are incorporated in this Section 1 as if fully restated.

 

 

                     SECTION 2

 

 

Area. The area constituting the Second Amended Redevelopment Project Area for the MST TIF is described and depicted as set forth in the attached EXHIBIT A.

 

 

                     SECTION 3

 

 

Discontinuation of the MST TIF: The Main Street Tax Increment Finance District of the Village of Orland Park shall be discontinued, dissolved and shall be of no further force and effect as of the effective date of this Ordinance.

 

 

SECTION 4

 

 

Severability. If any Section, paragraph or provision of this Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such Section, paragraph or provision shall not affect any of the remaining provisions of this Ordinance.

 

 

SECTION 5

 

 

Repeal. That all ordinances, resolutions, motions or parts that conflict with this Ordinance shall be and the same are hereby repealed.

 

 

                     SECTION 6

 

 

Effect. That this Ordinance shall be in full force and effect upon its adoption, approval and publication in pamphlet form as provided by law.
