PROJECT DESCRIPTION & DETAILED PLANNING DISCUSSION

The purpose of this petition is to remove the vinyl fence fragments along the Northern boundary of the property and replace it with a continuous vinyl fence, inside the parcel property lines.  The existing fence pieces are currently not continuous and have been placed in staggered horizontal and diagonal manners along the projected line for the new fencing. This will create separation between the town homes and the adjacent property to the North, Empire Tire.

The proposed layout of the fence is outlined on the subdivision plat and the fence company’s scope of work has been included on the subdivision plat by the petitioner.  The vinyl fence will begin on the Western boundary of the property and extend East for a total of 674 feet.  The proposed fence from the scope of work will be six (6) feet tall, vinyl, and tan in color.

The recommendation motion includes the following conditions:

1) Install fence and footings entirely within petitioner’s property.

2) Install finished side of fence towards street and neighboring properties.

3) Meet all final building code related items.

Section 6-104.F - Obstruction of Public Right of Way of the Land Development Code (LDC) states that except as otherwise permitted by these regulations, no structure, fence, landscaping, driveway, parking lot, newspaper vending machine or mailbox shall be permitted which obstructs or otherwise interferes with public use of a street right-of-way or other public easement.

Section 6-310. C.5 - states that no fence shall be constructed in such a manner as to impede or alter the natural surface water drainage of the property upon which the fence is constructed or any adjoining property. A fence shall be installed three (3) inches above the ground as measured from grade to bottom of fence panel to allow for natural surface water drainage.

As the topography along the property lines where the fence is proposed is uneven, care should be taken to ensure the proposed fence does not alter existing water drainage.

Section 6-310. E.5(a)(b) - states that perimeter fences shall be located behind the front building line. It also states fences located in the side or rear yards not facing a public right of way shall be of any material and design allowed in section 6-310 (B) and (C), shall not exceed 6 feet in height, and may be located all the way up to the property line.

Overall, the project conforms to the Village’s Comprehensive Plan, Land Development Codes and policies for this area.
