Supplement 1 - V3 Companies: Construction Management

History

On February 4, 2009, a scope and fee proposal was received from V3 to provide professional Construction Management services.  At the time this proposal was received no actual construction work had commenced, but the first of the ensuing projects to install new watermains outside of the new roadway intersection footprint was being actively bid.  The V3 proposal was approved at the February 16, 2009, Board meeting.

 

Since then, numerous advance utility relocation projects were undertaken in 2010, including the watermain project, as well as the undergrounding of ComEd, AT & T, and Comcast overhead utility lines, and the installation of new natural gas mains and services in the same area.  All five of these projects have gone smoothly despite many, many challenges. 

 

The more significant challenges came with the watermain work, as expected, as that was the first project to break the surface of very old, well and diversely used, current and former business sites.  Though not totally unexpected, contaminated soils were found scattered about the watermain work zone which required intense oversight and control.  While the contaminated soils needs were being reviewed and resolved, the contractor was asked to move to other areas of the project to keep production moving.  Ultimately, the watermain joints and seals in the areas of contamination required very expensive petroleum-resistant seals and gaskets.  There was also added control and oversight to ensure that contaminated soils were properly tested and segregated to enable the Village to be properly positioned to back-charge companies that polluted the soil.  Please also remember that this project was awarded to a low-bid contractor that had ventured into somewhat unfamiliar territory in that a company established as an asphalt paving contractor was doing underground watermain work.  You may also recall that during July 2010, the Operating Engineer’s Union members went on strike for four weeks, totally halting all construction projects.  As these unanticipated construction management demands arose, staff directed that V3 provide a scope and fee proposal for each of these tasks and has been tracking the project costs via these individual Task Orders, drawing funds for payment from the overall Construction Management contract.  To-date, three Task Orders have been established managing five unanticipated activities.

 

As this was the first project to impact businesses, V3 worked with every contractor and business owner to address areas of concern, provide notice of any adverse impact to their business operation and find a means to provide most every accommodation requested.    

 

The anticipated labor effort that V3 used to provide their scope and fee proposal back in 2009 did not anticipate the added support required to manage work related to the Task Orders the added demands brought to-bear by this project.  On September 24, 2010, V3 provided the Village with an initial request for additional funding for the unanticipated work.  Their request was acknowledged, but not yet brought to the Board for action as Staff felt that it was premature to present such a request for a Supplement as there was still a very significant portion of the original contract award available.  Staff also anticipated additional unanticipated work and construction management effort would need to be undertaken related to the on-going environmental issues and utility relocation work remaining.

 

With the commencement of the roadway project at hand, during early December 2010, V3 was asked to provide a request for a comprehensive Supplement to provide professional Construction Management and Materials Testing services to complete the roadway and intersection improvement project, and to provide Design Engineering support during construction.  The attached January 31, 2011, proposal has been reviewed by staff and found to be appropriate for the management expectations that have been set and the effort required for the balance of the project.

 

It is Staff’s recommendation that the January 31, 2011, V3 request for Supplemental funding in an amount not to exceed $531,813.17 be accepted. 

 

On February 7, 2011, this item was reviewed and approved by the Public Works and Engineering Committee and referred to the Board for approval.

Financial Impact

Funds for this project are available within the approved Fiscal Year 2011 Capital Improvement Fund 054-0000-499.84-80.

 

Recommended Action/Motion

I move to approve authorizing Supplement Number 1 to the current contract with V3 Engineers and Consultants (P.O. 52393) to provide Professional Construction Management and Materials Testing services and Design Engineering support during construction by an amount not to exceed $531,813.17, thereby providing for a revised not to exceed contract value of $1,367,513.17;

Approve authorizing the Village Manager to sign the Supplemental Agreement Number 1.
