OVERVIEW AND BACKGROUND

The two-story, detached single family home is a Non-Contributing Structure in the Old Orland Historic District per Section 6-209 of the Land Development Code.

PROJECT DESCRIPTION & CONTEXT

The property currently has a square rear patio projecting from under the rear deck attached to the back of the residence. It measures approximately 9’x9’. The square patio is connected to the driveway to the east by a concrete walkway measuring approximately 13’x4’. Wrapped around both the square patio and walkway is an existing landscape bed which separates those structures from the lawn. The landscape bed measures approximately 22’ long and has a sloping design. The petitioner proposes to expand the existing back patio to 14’x 22’. The Petitioner is proposing to use poured, stamped concrete to mimic the existing pavers in the area. The new rear patio would replace the existing square patio, existing walkway and existing landscape bed. The new patio will be approximately 5 feet from the western fence and will abut the driveway to the east.

The Land Development Code, Section 6-209 Old Orland Historic District stipulates, “Substantial change to the exterior appearance of a structure, or any change to the impervious coverage on the site, including but not limited to: New Construction or additions, including new decks visible from the right-of-way, porches, driveways, etc… considered “major” by the Development Services Department. As this property is considered a non-contributing structure, a major change on a non-contributing structure requires only Administrative Review of the project.

The Land Development Code, Section 6-209 Old Orland Historic District stipulates “For all residential developments, no more than 80% of the area of the lot may be impervious. The remaining 20% must be maintained as green space.” The proposed expansion increases the lot coverage from 55.8% to 57.9%, which is within the regulations.

The Land Development Code, Section 6-209 Old Orland Historic District, Deteriorated Architectural Features, states that if the severity of deterioration requires replacement, new material should match the historic material being replaced in composition, design, color, texture and other visual qualities.

Section 6-209 of the Land Development Code does not provide regulations for patios. Thus, per Section 6-302 of the Land Development Code states terraces, patios, porches and decks may be permitted up to five (5) feet from the rear and side lot lines. The submitted plans for this project are compliant with that regulation.

Overall, the project conforms to the Village’s Comprehensive Plan, Land Development Codes and policies for this area.
