PROJECT DESCRIPTION & CONTEXT

The petitioner proposes to replace their existing dumpster enclosure at the multi-family building at 14405 Jefferson Avenue. The existing chain link/wood enclosure located at the rear of the site has deteriorated over time and needs to be replaced. The proposed enclosure will be built in the same located but be slightly larger so that the full-size dumpster will fit inside of it. The dumpster does not fit properly in the existing enclosure, so this new enclosure will properly screen the entire dumpster from public view. A site plan and drawings showing the proposed dimensions and materials have been submitted for review.

DETAILED PLANNING DISCUSSION

As shown in the submitted plans, the proposed fence will be 6’ tall and constructed of black vinyl coated CL with black privacy slats. The enclosure will also have 60” double gates in the front to allow for safe access to the dumpster while still screening it in accordance with code requirements. In total, the enclosure will be 10’ long and 8’ deep. The parking lot will not be altered with this project, and there are no other changes to the site proposed at this time.

Dumpsters and Trash Handling Areas

According to Section 6-302.D, dumpsters and trash handling areas shall be screened from view from public streets and any abutting properties by three opaque walls and an opaque gate. All dumpsters shall have lids that remain closed and remain inside garbage enclosure area at all times unless in use. The proposed enclosure meets this requirement.

Existing multi-family uses may construct enclosures using either wood or beige vinyl material as replacements to either wood or chain link existing enclosures or non-conforming trash handling areas. Since the existing dumpster enclosure is a non-conforming chain-link fence, the new proposed enclosure will be more conforming with an opaque vinyl fence. Therefore, this requirement is met.

Fencing

According to section 6-310.F, fences in a non-residential district may be either solid or up to 50% open and shall not exceed 8’ in height. The proposed fence is a 6’ tall privacy fence to enclose the dumpster in the rear of the property.

According to Section 6-310.C, no fence shall be constructed in such a manner as to impede or alter the natural or engineered surface water drainage of the property upon which the fence is constructed or any adjoining property. A fence shall be installed 3” above the ground as measured from grade to the bottom of the fence panel to allow for natural surface water drainage. Fences located in overland flow routes may have additional requirements pertaining to height above ground and being an open fence style in order to maintain stormwater flow as determined by the Director of Engineering. This requirement shall be met.
