AN ORDINANCE AMENDING TITLE 6, CHAPTER 1 (HEALTH CODE) AND TITLE 7, CHAPTER 3 (REGULATIONS FOR SPECIFIED BUSINESSES) OF THE ORLAND PARK VILLAGE CODE
Body
WHEREAS, the Village President and Board of Trustees of the Village of Orland Park (the “Village”) have the authority to adopt ordinances and to promulgate rules and regulations that pertain to its government and affairs and protect the public health, safety, and welfare of its citizens; and
WHEREAS, pursuant to 65 ILCS 5/1-2-1, the Village may pass all ordinances and make all rules and regulations proper or necessary, to carry into effect the powers granted to municipalities; and
WHEREAS, the Village deems it to be in the best interest of the public to provide an extended duration of permits for temporary food service establishments in certain instances and to regulate mobile food units.
NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Orland Park, Cook and Will Counties, Illinois, and pursuant to its home rule powers, as follows:
SECTION 1
The above recitals are incorporated herein by reference as though fully set forth herein.
SECTION 2
Title 6, Chapter 1, Section 6-1-3-3 of the Orland Park Village Code is amended in its entirety to read as follows:
“6-1-3-3: PERMIT DURATION:
Temporary Food Service Establishments permits are valid for fourteen (14) days after issuance. A maximum of two (2) permits may be granted for each event. In addition, a permit may be issued, upon approval by the Village Board of Trustees, for up to ninety (90) days provided the permittee is lawfully operating, or engaged in constructing, a permanent food service establishment at a location adjacent to the Temporary Food Service Establishment location.”
SECTION 3
Title 7, Chapter 3, Section 7-3-5 (MOBILE FOOD UNITS) is deleted in its entirety and replaced with the following:
“7-3-5: MOBILE FOOD UNITS:
It shall be unlawful to sell, distribute or serve food from a mobile unit on the public streets and ways of the Village. The sale, distribution or serving of food from a mobile food unit shall be limited to privately owned premises such as construction sites, industrial areas and Temporary Food Service Establishments permitted in accordance with Section 6-1-3 of this Code, provided consent is first obtained from the owner or person in charge of such privately owned premises.”
SECTION 4
This Ordinance shall be in full force and effect from and after its adoption and publication in pamphlet form as provided by law.
